to give this section its most reasonable application. For the purpose of this section, the words <br />"must" and "shall" are mandatory and not permissive. All distances, unless otherwise specified, <br />shall be measured horizontally. <br /> <br /> Bluffiine - The line which generally follows the river bank where the slope changes from <br />steep (more than 12 percent) to less than 12 percent). <br /> <br />Clear-cutting- The removal of an entire stand of trees. <br /> <br /> Conditional Use - A land use or development as defined by section that would not be <br />appropriate generally but may be allowed with appropriate restrictions as provided by official <br />controls upon a finding that certain conditions as detailed in the zoning ordinance exist, the use or <br />development conforms to the comprehensive land use plan of the community, and the use is <br />compatible with the existing neighborhood. <br /> <br />Critical Root Zone - The portion of a root system within the dripline of a tree. <br /> <br /> Crown Cover - The ratio between the amount of land shaded by the vertical protection of <br />the branches and foliage area of standing trees to the total area of land, usually expressed as <br />percentage. <br /> <br /> Development - The construction, installation or alteration of any structure, the extraction, <br />grading or filling, clearing or other alteration of terrestrial or aquatic vegetation, land or the <br />course current or cross-section of any water body or water course or the division of land into two <br />or more parcels. <br /> <br /> Dimensional Requirement - Minimum and maximum setbacks, yard requirements and/or <br />structure height or size restrictions established in Chapter 9 for the various zoning districts. <br /> <br /> Dripline - An imaginary vertical line which extends from the outermost branches of a tree's <br />canopy to the ground. <br /> <br />Litter - Slightly decomposed organic material on the floor of a wooded area. <br /> <br /> Lot - A parcel of land designated by plat, metes and bounds, registered land survey, auditors <br />plot, or other accepted means and separated from other parcels or portions by said description for <br />the purpose of sale, lease, or separation thereof. <br /> <br /> Nonconformity- Any legal use, structure, or parcel of land already in existence, recorded, or <br />authorized before the adoption of official controls or amendments thereto that would not have <br />been permitted to become established under the terms of the official controls as now written, if <br />the official controls had been in effect prior to the date it was established, recorded or authorized. <br /> <br /> Ordinary High Water Level - The boundary of public waters and wetlands, and shall be an <br />elevation delineating the highest water level which has been maintained for a sufficient period of <br />time to leave evidence upon the landscape commonly that point where the natural vegetation <br />changes from predominantly aquatic to predominantly terrestrial. For watercourses, the ordinary <br />high water level is the elevation of the top of the bank of the channel. For reservoirs and <br />flowages, the ordinary high water level is the operating elevation of the normal summer pool. <br /> <br />-3- <br /> <br /> <br />
