Based on advisement <br />by the City Attorney, the list of properties for acquisition has been revised to the parcels that <br />have been scheduled in the Capital Improvement Plan. It is timely to complete this action <br />tonight, as the next City Council meeting is not scheduled until February 28, and staff is <br />requesting that the recommendation be made prior to March 1. <br /> <br />Mayor Gamec asked if the property owners have been contacted. <br /> <br />City Administrator Norman responded in the affirmative. <br /> <br />Mayor Gamec requested clarification that there can still be negotiations with the property owners <br />after the eminent domain process has begun. <br /> <br />City Administrator Norman responded in the affirmative. He advised the proceedings will be a <br />lengthy process. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Resolution <br />#06-02-053 authorizing eminent domain for the acquisition of parcel #27-32-25-33-0011 <br />identified in said resolution for economic development purposes, to adopt Resolution #06-02-054 <br />authorizing eminent domain for the acquisition of parcel #27-32-25-44-0003 identified in said <br />resolution for economic development purposes, to adopt Resolution #06-02-055 authorizing <br />eminent domain for the acquisition of parcel #27-32-25-43-0014 identified in said resolution for <br />economic development purposes, and to adopt Resolution #06-02-056 authorizing eminent <br />domain for the acquisition of parcel #27-32-25-44-0006 identified in said resolution for <br />economic development purposes. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Pearson, Cook, Jeffrey, Olson, <br />Pearson, and Strommen. Voting No: None. Absent: Councilmember Elvig. <br /> <br />Case #2: <br /> <br />Consider Approval of Acquisition of Easements for the NW Trunk Sanitary <br />Sewer Extension <br /> <br />City Administrator Norman explained this case deals with completion of the work for the NW <br />Trunk Sanitary Sewer Extension Program. He reviewed past actions taken by the Council <br />regarding the sewer extension. Mr. Norman advised them are 54 properties along the selected <br />alignment. The elimination of the trail has been well received by the remaining parcels. A <br />memo from The Tinklenberg Group, the list of property owners contacted, and the proposed <br />amounts are included in the Council's packet, as well as exhibits showing the location of each <br />parcel. He advised Jodi Ruehle of The Tinklenberg Group has been unable to reach Mr. Ulvog, <br />owner of Parcel No. 26, who travels extensively. <br /> <br />City Administrator Norman advised staff recommends approval of the completed negotiations <br />with the 13 property owners.
