Community Development Director Trudgeon advised with the proposed changes, staff is also <br />looking for a stricter stance on allowing conditional use permits. It is important to discuss <br />establishing criteria for obtaining a conditional use permit. Such criteria could include a special <br />use, additional landscaping requirements, or larger lot sizes. Currently, there are no criteria in <br />City Code permit for accessory structure overages. It is suggested that, in the future, the only <br />overages considered would be those uses that are allowed by conditional use permit for other <br />reasons. Mr. Tmdgeon advised staff recommends introducing the ordinance to amend Section <br />9.11.02 of City Code. <br /> <br />Mayor Gamec expressed concern that a large accessory building built in the back yard could <br />become the dominant building on a property. He requested staff to look into this issue further. <br /> <br />Councilmember Strommen inquired aborn the criteria that might be established for accessory <br />structure overages. <br /> <br />Community Development Director Trudgeon replied the criteria should be incorporated into the <br />ordinance. This should be a priority, as it will be important once the building season begins. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Jeffrey, to introduce an <br />ordinance amending Section 9.11.02 (Accessory Structures). <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #6: <br /> <br />Introduce Ordinance to Amend Section 9.21 (Environmental Protection) of <br />the City Code <br /> <br />Community Development Director Tmdgeon reviewed that staff has been working with the DNR <br />and Hoisington Koegler to update Ramsey's Mississippi River zoning regulations to comply with <br />the 2002 update of the City's Comprehensive Plan. Generally, the ordinance was drafted to <br />comply with state requirements while accommodating existing development on the river and to <br />enable new development according to the City's current Comprehensive Plan. The proposed <br />code contains high standards for protecting the fiver corridor while allowing new development <br />through the Planned Unit Development (PUD) process. Mr. Trudgeon explained the City's <br />Comprehensive Plan currently requires new development within the corridor to permanemly <br />dedicate 50% of the property as open space, protected by a conservation easement or similar <br />instrument. In the enclosed ordinance, staff is recommending that a combination of public <br />and/or private open space be permitted for new development, to be considered on a case-by-case <br />basis. Staff feels that some flexibility in this area would be beneficial, but permanent open space <br />for riverfront parcels would still be a priority. Because the proposed ordinance reflects a change <br />from the current Comprehensive Plan, staff is asking the Council to consider a more flexible <br />open space definition. If the Council is agreeable, the definition will be changed accordingly in <br />the 2008 Comprehensive Plan update. Mr. Trudgeon advised staff needs to continue to study the <br />language referring to permanent open space, and to tighten the language up to be clearer.
