Community Development Director Trudgeon advised staff recommends approval of the final plat <br />subject to the City Staff Review Letter dated March 9, 2006, the Developer entering into a <br />Development Agreement with the City, and the vacation of the drainage and utility easements on <br />Lot 1, Bock 1, Westby First Addition. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Resolution <br />#06-03-079 to approve the final plat of Brookfield First Addition contingent upon compliance <br />with the City Staff Review Letter dated March 9, 2006, the Developer entering into a <br />Development Agreement with the City, the vacation of the drainage and utility easements on Lot <br />1, Bock I, Westby First Addition, and the City receiving the $6 million dollar of credit from the <br />Developer. <br /> <br />Further discussion: Councilmember Jeffrey noted the consensus of the Council that the <br />development agreement state that monuments be placed at the limits of the wetland, and that a <br />15-foot structure setback should be implemented from the wetland limits. Community <br />Development Director Trudgeon indicated this is included in the Staff Review Letter and will <br />also be included in the development agreement. Councilmember Elvig expressed his <br />appreciation for staff's work on this project, which is large and has had a lot of complications. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Pearson, Elvig, Jeffrey, <br />Olson, and Strommen. Voting No: None. <br /> <br />Further discussion: Jim Overtoom, 16660 Jasper Street, stated almost one year ago there was <br />considerable discussion about this project with the neighboring properties, dealing with the <br />transition issues of rural Ramsey to downtown Ramsey. There was discussion of additional <br />landscaping and plantings to accommodate the transitioning. He requested information <br />regarding the density and location, not only for the first addition, but for the remainder of the <br />project. Mr. Trudgeon replied the Staff Review Letter calls out a couple of areas the developer <br />has been directed to correct, and will need to be revised with additional plantings. Staff can <br />review this information with Mr. Overtoom once it is received from the developer to be certain it <br />is satisfactory. <br /> <br />Case #5: <br /> <br />Adopt Ordinance Amending Section 9.11.02 (Accessory Structures) of the <br />Zoning Chapter of City Code <br /> <br />Community Development Director stated at the Planning Commission meeting in October 2005, <br />the Commissioners expressed a desire to review and possibly alter the accessory structure size <br />limitations in order to reduce the number of conditional use permits granted for size overages <br />each year. Between 2003 and 2005, the City issued 161 buildings permits for garages. During <br />that time, the Planning Commission and City Council heard and approved 17 requests for <br />conditional use permits to exceed maximum square footages on accessory structures. Of the 17 <br />requests for conditional use permit to exceed maximum square footage on accessory structures, <br />15 have been for lots between the sizes of .5 acres and 2.5 acres. He reviewed the suggested <br />revisions, which focus on lot-size in relation to adjusting size categories and increasing allowable <br />square footages. <br /> <br />City Council / March 14, 2006 <br /> Page 11 of 25 <br /> <br /> <br />
