determined at that stage that the preparation of an Environmental Impact Statement (EIS) is not <br />required for this development. <br /> <br />Community Development Director Trudgeon explained the Wetland Buffer Ordinance was not <br />in effect at the time of preliminary plat approval. However, staff is suggesting that in lieu of the <br />fact that wetland buffers were not a requirement at the time of preliminary plat review, that <br />monuments be placed at the limits of the wetland. Also, like the wetland buffer ordinance, a 15- <br />foot structure setback should be implemented from the wetland limits. If the Council agrees to <br />these suggestions it would be included in the development agreement. <br /> <br />The consensus of the Council was to include staff's suggestion regarding the monuments being <br />placed at the limits of the wetland and the 15-foot structure setback in the development <br />agreement. <br /> <br />Community Development Director Trudgeon explained some revisions are required to the <br />landscaping plan per the City Staff Review Letter. Staff is recommending some additional <br />landscaping along Blocks 3 and 4 to satisfy density transition requirements. During their review <br />of the preliminary plat, the Planning Commission also requested additional landscaping in these <br />areas. He advised the proposal for the first phase of Brookfield includes the construction of <br />Limonite Street, 167th Terrace, Olivine Street, and 170th Trail, which complies with the approved <br />preliminary plat, but results in only one access for this phase until other phases come on line. <br />Public safety requires that a second outlet be provided for access to these lots. Staff is <br />recommending that the number of building permits for this addition be limited to 16 until a <br />second paved ingress/egress is provided, either through future phase additions or through a <br />temporary paved connection. <br /> <br />Assistant Public Works Director Olson explained the City will be putting in a lift station on the <br />west side of this development that will require a three phase electric service. Staff is expecting <br />the east/west connection to be completed as part of this development. There is strict language <br />included in the development agreement that requires operational sewer and water before <br />Certificate of Occupancies are given. In addition, the watermain goes through the north portion <br />of this property. Item no. 18 of the development agreement requires the developer to submit <br />construction plans for the construction of a 10-foot bituminous trail adjacent to Trott Brook, <br />from the westerly limits of the plat to Nowthen Boulevard as identified on the final plat. <br /> <br />Mr. Trudgeon indicated requirements for building and occupancy permits are listed under item <br />no. 15 of the development agreement. One of these requirements is that the water system is <br />functional and looped between Variolite Street and CSAH 5. He advised park dedication <br />requirements for the plat are being satisfied through a cash payment. He explained the applicant <br />will be constructing trails along the southern boundary of Trott Brook and along Nowthen <br />Boulevard. Staff is recommending that the entire trail along Trott Brook be constructed as a part <br />of the First Addition. <br /> <br />City Attomey Goodrich advised the utility agreement has not yet been signed, but the developer <br />is agreeable to the terms.
