approval shall be contingent upon receipt of such a permit. General details concerning soil type, <br />and the design and location of the community septic have been submitted. <br /> <br />Staff is requiring that ail sewer and water infrastructure be installed prior to the construction of <br />the streets. The applicants have submitted information regarding the proposed water source for <br />the proposed lots and individual wells are proposed. Staff has requested revisions regarding the <br />water utilities and maintenance plan. <br /> <br />The plat proposes to gain access from Wolverine Street, through the proposed Rum River Prairie <br />development. Staff is requiring that 17Ist Street be constructed to provide a second access to both <br />Kelly Acres and Rum River Prairie and the street plans indicate this construction. <br /> <br />A trail will be required to be constructed on. the east side of Armstrong Boulevard per the City's <br />Park and Trail Plan. Also, a sidewalk will be required to be constructed along Tiger Street and on <br />one side of 171st Avenue. <br /> <br />The tree preservation plan, grading plan, and drainage plan are generally acceptable to staff, <br />though some modifications are requested. <br /> <br />The public hearing was held on March 3, 2006, and a number of residents expressed their <br />concern with the proposed project. The primary concerns were the size of the proposed lots, the <br />eventual extension of urban services to the area, and the general concept of cluster housing. <br /> <br />Recommendation: <br /> <br />The Planning Commission conducted a public hearing on March 3, 2006 regarding the <br />preliminary plat. The Commission recommended approval of the preliminary plat with the <br />following contingencies: <br /> <br /> I. MPCA approval of the common septic system <br /> 2. Resolution of the lot size issues for the existing homes <br /> 3. Completion of the traffic study <br /> 4. City Council re-consideration of the cluster ordinance <br /> <br />It is noted that on March 28, 2006, the City Council introduced a proposed interim ordinance that <br />would place a one-year moratorium on platting and subdividing land in the R-1 Rural <br />Developing Zoning District. The purpose of the moratorium is to review the ordinance in more <br />depth with respect to density transitioning standards, open space provisions, the calculation of <br />density, and specific septic system submittal requirements. If that ordinance is adopted on April <br />I 1th, 2006 the effective date will be Monday, May 15t~, 2006. Any plats in the Rural Developing <br />Area receiving preliminary plat approval prior to May 15th are exempt from the moratorium. <br /> <br />Given the issues discussed relating to the impending moratorium, approval of the preliminary <br />plat for Kelly Acres should contain the following contingencies: <br /> <br />-106- <br /> <br /> <br />
