CASE # 5 <br /> <br /> REQUEST FOR VACATION OF EASEMENTS <br />IN THE PROPOSED PLAT OF BROOKFIELD FIRST ADDITION; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br /> By: Amy Geisler, AICP, Associate Planner <br /> <br />Background: <br /> <br />The plat of Brookfield eliminates the need for Marble Street N.W. and 167th Avenue N.W., <br />adjacent to Lot 1, Block 1, Westby First Addition. The plat of Brookfield also replats Lot 1, <br />Block 1, Westby First Addition and eliminates the need for the standard drainage and utility <br />easements ~long the property lines of that lot. Council granted f'mal plat approval to Brookfield <br />First Addition on March 14, 2006 contingent on approval of the requests for easement vacation. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Proposed Ordinances <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />The City Council introduced the ordinance to vacate the pertinent easements at the March 28, <br />2006 Council meeting. The ordinance is now eligible f(~r adoption. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the ordinance to vacate the road and drainage and utility <br />easements adjacent to and within Lot 1, Block 1, Westby First Addition. <br /> <br />-193- <br /> <br /> <br />
