Community Development Director Trudgeon advised that the City has received an application <br />from Cingular Wireless to construct and operate a monopole communication tower, intended to <br />fill a gap in Cingular's wireless phone network. He stated the proposed tower will be located at <br />6405 Green Valley Road on property owned by Jeffrey and Caroline Rowe. <br /> <br />Community Development Director Trudgeon stated that towers are permitted in residential <br />districts as long as they are located in the Tower Overlay District and are at least 10 acres in size. <br />He indicated that the subject property is located with the Tower Overlay District, but does not <br />meet the minimum lot size of 10 acres. He indicated that when the Ro~ve lot was created, the <br />County requested an additional 27 feet of right-of-way to be dedicated for Green Valley Road. <br />He stated that if the right-of-way is included, Lot 4 is approximately 10.3 acres. <br /> <br />Community Development Director Trudgeon advised that City Code requires that all <br />communications towers be located 1 ½ times the height of the tower away from any lot line. He <br />stated that in this instance, the proposed tower must be located 180 feet away from any lot line. <br />He stated that the current site plan shows the tower only being located 130 feet from the east <br />property line. He indicated that Staff has talked to the representative from Cingular and he feels <br />that the tower can be moved an additional 50 feet. <br /> <br />Community Development Director Trudgeon stated that due to the need of a variance and the <br />necessity to move the location of the communications tower, Staff is recommending that the <br />conditional use permit request to locate a communications tower be tabled until the April <br />Planning Commission meeting. <br /> <br />Commission Input <br /> <br />Motion by Commissioner Van Scoy, seconded by Commissioner Levine to continue the request <br />by Cingular Wireless for conditional use permit to construct a monopole communications tower <br />to the April Planning Commission meeting. <br /> <br />Motion Carried. Voting Yes: Vice Chairperson Johnson, Commissioners Van Scoy, Levine, <br />Brauer, Cleveland, and Shepherd. Voting No: None. Absent: Chairperson Nixt. <br /> <br />Case #9: <br /> <br />Information Item: Revised Sketch Plan for Shorewalk; Case of Shorewalk, <br />LLC <br /> <br />Presentation <br /> <br />Community Development Director Trudgeon advised that Shorewalk, LLC had originally <br />submitted a sketch plan to develop the 90-acre property east of Sunfish Lake as a Planned Unit <br />Development with a mix of 343 single family and townhome units.
