Mr. Berger announced The Ramsey Lions will be
holding the annual picnic the first Saturday in June at Central Park.

Case #6:

Request for an Extension of Time to Initiate and Utilize Variance; Case of
Jeff and Jill Stevenson

Ass't Community Development Dir/HRA Executive Dir. Frolik explained on April 7, 2005, the
Board of Adjustment approved Jeff & Jill Stevenson's request for a variance to construct a
detached garage closer to the front property line than the home. City Code states that a variance
shall become null and void one year after the final action of the Board of Adjustment if it is not
initiated or utilized. A variance holder may petition for an extension of time to utilize the
variance through a written request. The Stevensons are requesting an extension of time to enable
them to utilize this variance. The site conditions have not changed since the variance was
approved nor has the site plan. Ms. Frolik advised staff recommends approving the Stevensons
request for an extension of time to utilize their variance until October 7, 2006.

Councilmember Elvig inquired if six months is enough time for the extension.

Jeff Stevenson, applicant, replied the six months is actually more than was requested. They are
hoping to be in the ground in July; they are in the process of getting the bids in order and
applying for the permit.

Motion by Councilmember Elvig, seconded by Councilmember Cook, to grant a six month
extension to utilize a variance to construct a detached garage closer to the front property line than
the home.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Olson,
Pearson, and Strommen. Voting No: None.

Case #7:

Request to Appeal Board of Adjustment Decision to Deny a Variance to the
Maximum Cul-De-Sac Length: Case of Shade Tree Communities

Ass't Community Development Dir/HRA Executive Dir. Frolik stated Shade Tree Communities
is requesting an appeal to the denial of a variance request to maximum cul-de-sac length of 600
feet in order to provide access to the proposed lots and construct proposed Erkium Street NW to
the southerly extent of the parcel to be developed as Shade Tree Creek. Ms. Frolik advised today
staff reviewed the requirements for extending roads to property boundary lines with City
Attorney Goodrich. The way the code is written, it appears there is more precedence given to the
600 foot cul-de-sac length than the stated attempt to continue roads to property boundaries. On
that basis, staff would recommend findings of fact numbers 6 and 11 be amended.

City Attorney Goodrich advised finding of fact numbers 6 and 13 are recommended to be deleted
and replaced with the following findings:

City Council / March 28, 2006
