· The School shall have primary (not exclusive) use of the premises on school days until <br /> 5:30 or 6:00 p.m., and the City shall maintain full use of the park outside of this period <br /> unless agreed to otherwise. <br />· The City may preempt the School's scheduled use if needed (as in the case of parking for <br /> an event as an example). <br />· Either party may cancel the agreement upon a 90-day notice, or the City may cancel with <br /> a 30-day notice ifa default by the School occurs. <br />· The agreement may be amended each year by the City and adjusted accordingly - based <br /> upon costs and actual experience. <br />· The City shall perform all maintenance except the School shall perform all litter control <br /> and removal on school days. <br /> <br />Mr. Riverblood stated in consideration for this agreement, PACT Charter School will pay a base- <br />rate fee of $500 per year, and a field maintenance fee consistent with those fees charged other <br />youth athletic associations in Ramsey. <br /> <br />Mr. Riverblood explained for several years, the youth athletic groups have been paying for a <br />small portion of athletic field maintenance costs directly attributable to their activity. For 2006, <br />staff is proposing a nominal per game fee for each sport, rather than a more arbitrary supply <br />"pass through" fee. The net cost to the youth associations would be very similar and was <br />anticipated within the spring program budgets consistent with past years. Mr. Riverblood <br />explained each time a game is scheduled for play, one or more workers are dispatched to that <br />field to stripe, drag, or chalk the fields. This is the only time these fees would be assessed. For <br />baseball and softball, this activity occurs each day there is a game. For soccer and football, field <br />striping occurs once a week. Mr. Riverblood reviewed the proposed per game/week fees for the <br />spring programs, and advised the existing and past president of the youth association agreed to <br />the schedule, which is very similar to the costs paid for by the youth association in the past. He <br />advised it is anticipated that this schedule may be examined annually as part of the annual Rates <br />and Charges Schedule and adopted each year by Council in December. <br /> <br />Motion by Councilmember Cook seconded by Councilmember Elvig, to approve the 2006-2007 <br />Field Use Agreement with the PACT Charter School, subject to all applicable laws and approval <br />by both the City Attorney and City Administrator, and to approve the proposed athletic field <br />maintenance fees for youth athletic associations and schools for 2006. <br /> <br />Further discussion: Councilmember Elvig expressed his agreement with the collaborative effort <br />of this agreement. He requested clarification that the City has not yet received the park property. <br />Mr. Riverblood replied this agreement states the agreement would be valid at such time as the <br />Council approves it or that the City accepts the park from the developer and deemed it available <br />for play, whichever comes later. Councilmember Elvig noted the park was developed by the <br />developer at their cost. He suggested the agreement be amended to state the school shall have <br />primary use of the premises on school days until 6:00 p.m., rather than 5:30 or 6:00 p.m. Mr. <br />Riverblood replied this is the only ambiguity in the agreement. He explained the school wanted <br />use until 6:00, but his concern was that the youth association typically starts their use at 6:00, <br />and he did not want to see that overlay. He and the School Administrator agreed to have the time <br />set at 5:30 or 6:00, and that it would be sorted out if there were to be a problem.
