Mr. Trudgeon advised staff recommends approval of the site plan contingent upon <br />compliance with City Staff Review letter dated March 28, 2006, revised April 21, 2006, and the <br />Developer entering into a TIF Agreement. <br /> <br />Councilmember Elvig inquired about the back portion of the building being leased out, as there <br />is no access in this area. <br /> <br />Community Development Director Trudgeon replied the applicant has indicated the back portion <br />of the building currently will not be used, and they will explore leasing it out. It would likely be <br />used for a warehouse or storage use. <br /> <br />Councilmember Elvig inquired if staff has any concerns regarding the leasing arrangement. <br /> <br />Community Development Director Trudgeon replied whether the applicant uses the full building <br />or the back part is leased, the use must be in conformance with the zoning code, and there must <br />be adequate turning circulation. <br /> <br />Councilmember Elvig suggested staff inform the applicant that the sunken area depicted on the <br />site plan facing directly northwest will fill with snow in the winter when it is windy. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Pearson, to grant approval of <br />the proposed site plan of Riverside Manufacturing; Case of Stone Construction, contingent upon <br />compliance with City Staff Review Letter dated March 28, 2006, revised April 21, 2006. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit for a Monopole Communications <br />Tower; Case of Cingular Wireless, Inc. <br /> <br />Community Development Director Trudgeon stated the City has received an application from <br />Cingular Wireless to construct and operate a monopole communication tower, intended to fill a <br />gap in Cingular's wireless phone network. The proposed tower will be located at 6405 Green <br />Valley Road on property owned by Jeffrey and Caroline Rowe. Towers are permitted in <br />residential districts as long as they are located in the Tower Overlay District and are at least 10 <br />acres in size. The subject property is located within the Tower Overlay District but does not <br />meet the minimum lot size of 10 acres. The subject property is approximately 9.27 acres in size. <br />Mr. Trudgeon explained the minimum lot size in the area is ten acres. As part of the Valley <br />View Estates plat approved in 2000, four lots were created, all less than I0 acres. The original <br />parcel was 38.7 acres and the developer received a variance for Lots 1-3 for lot size and lot <br />width. Lot 4, the subject property, was allowed to be created as a remnant parcel per City <br />Ordinances. It should be noted that when Lot 4 was created, the County requested an additional <br />27 feet of right-of-way to be dedicated for Green Valley Road (CR 63). If the right-of-way is <br />included, Lot 4 is approximately 10.3 acres.
