Community Development Director Trndgeon reviewed the area to be vacated. He stated the <br />easement vacation will not affect any easement on Mr. Smith's property, nor should it affect any <br />tree plantings Mr. Smith currently has. Later tonight there will be a discussion of the final plat <br />for Brookfield, where additional lots will be created and stub roads put in close to Mr. Smith's <br />property. If anything will be affected it would occur during construction time, but care will be <br />taken to ensure that the adjoining properties are not affected. This easement vacation will not <br />affect anything on Mr. Smith's lot. <br /> <br />Mr. Smith stated his main concern is not to lose any of his pine trees; hopefully these trees will <br />provide a transition separating his 2 ½ acre lot from the residential area. <br /> <br />Community Development Director Trudgeon explained there will be additional plantings to meet <br />the transitioning criteria. They will do what can be done in the field to be sure the adjoining <br />properties are not impacted. However, if there are any concerns in regards to construction, <br />property owners should contact City Hall, and an inspector will come to the site right away. <br /> <br />Mr. Smith stated there is a Iow lying area on the southeast part of Lots 1 and 2. He expressed <br />concern that his property will become a low lying area if this area were to be raised. <br /> <br />Community Development Director Trndgeon replied the plans have been reviewed by the <br />Engineering Department. The development cannot impact an existing lot, and no additional <br />drainage or runoff can go onto an existing lot. On paper, the plat has been designed without an <br />impact to Mr. Smith's property, but if an impact is noticed or there are any questions, Mr. Smith <br />should contact the Engineering Department. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Elvig, Olson, <br />Pearson, and Strommen. Voting No: None. <br /> <br />The public hearing was closed at 7:19 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:19 p.m. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to introduce an ordinance <br />to vacate the drainage and utility easements on Lot 1, Block 3, Now and Then Estates. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey, <br />Pearson, and Strommen.
