Community Development Director Trudgeon stated Mr. and Mrs. Benz own and live at the <br />property at 15410 Hematite Street. The home on the property was constructed in 1967 and the <br />Benz's are proposing to demolish the home and construct a new home on the property. They <br />would like to live in the existing home while the new one is being constructed. For a temporary <br />period of time, there will be two homes on the property and the Benz's have applied for an <br />interim use permit to allow this to happen while the new home is being constructed. The <br />proposed permit is drafted to require that the new home be constructed within six months, that <br />the applicants take occupancy of the new home within 30 days of issuance of certificate of <br />occupancy, and the existing home be demolished and removed within 60 days of the issuance of <br />certificate of occupancy for the new home. In the event the weather conditions are not <br />conducive to backfilling the previous house foundation and septic system, the Building Official <br />will have the authority to grant a maximum 60 day extension. Any extensions required beyond <br />that time frame must be approved by the City Council. <br /> <br />Community Development Director Trudgeon explained the interim use permit will require the <br />applicants to post a financial surety at the City to ensure that the old home and septic system are <br />properly abandoned in a timely manner. In addition to the interim use permit, it is the <br />applicant's responsibility to obtain all other necessary permits. Mr. Trudgeon advised the <br />Planning Commission and staff recommend approval of the interim use permit to temporarily <br />maintain two dwelling units on one parcel. <br /> <br />Mayor Gamec inquired if the applicant has any problems or questions regarding the permit. <br /> <br />Nancy Benz, applicant, responded they do not. She stated the only problem the Planning <br />Commission discussed was whether there is enough time allowed for the new home to be <br />constructed. <br /> <br />Councilmember Elvig commented this type of situation is something they should likely get used <br />to in the City. With the value of property and some of the older homes in the community he <br />would suspect more people will want to save the property they own. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Elvig, to adopt resolution #06- <br />04-132 adopting Findings of Fact #0759 relating to Mr. and Mrs. Benz's request for an interim <br />use permit to maintain two dwellings on one parcel for a temporary period of time. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Elvig, Cook, Olson, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Elvig, to approve Mr. and Mrs. <br />Benz's request for an interim use permit, based on findings of fact, to maintain two dwellings at <br />15410 Hematite St. for a temporary period of time and adopt resolution #06-04-133. <br /> <br />Motion carded.
