CASE # 3 <br /> <br /> REQUEST FOR AN INTERIM USE PERMIT <br />TO MAINTAIN TWO DWELLINGS ON ONE PARCEL; <br />CASE OF MICHAEL AND NANCY BENZ <br /> By: Jason Schmidt, Management Intern <br /> <br />Background: <br /> <br />City Code states that them shall not be more than one main building on a lot unless otherwise <br />provided for in City Code. Mr. and Mrs. Benz own and live at the property at 15410 Hematite <br />Street. The home on the property was constructed in 1967 and the Benz's are proposing to <br />demolish the home and construct a new home on the property. They would like to live in the <br />existing home while the new one is being constructed. For a temporary period of time, there will <br />be two homes on the property and the Benz's have applied for an interim use permit to allow this <br />to happen while the new home is being constructed. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site Plan <br />New home building elevations <br />Proposed findings of fact <br />Proposed interim use permit <br /> <br />Notification: <br /> <br />In accordance with State statute, City Staff attempted to notify all owners of property within 350 <br />feet of the Subject Property of the request for Interim Use Permit and public hearing. <br /> <br />Observations: <br /> <br />The Subject Property is approximately 3.5 acres in size and is located in the Rural Developing <br />area of the R-1 Residential District. The Applicants are proposing to live in the existing home on <br />the property while their new home is being constructed. <br /> <br />The proposed permit is drafted to require that the new home be constructed within 6 months, that <br />the applicants take occupancy of the new home within 30 days of issuance of certificate of <br />occupancy, and the existing home be demolished and removed within 60 days of the issuance of <br />certificate of occupancy for the new home. In the event the weather conditions are not conducive <br />to backfilling the previous house foundation and septic system, the Building Official will have <br />the authority to grant a maximum 60 day extension. Any extensions required beyond that time <br />frame must be approved by the City Council; <br /> <br />The Interim Use Permit will require the Applicants to post a financial surety at the City to ensure <br />that the old home and septic system are properly abandoned in a timely manner. In addition to <br />the Interim Use Permit, it is the Applicants responsibility to obtain ali other necessary permits. <br /> <br />-191- <br /> <br /> <br />
