Mr. and Mrs. Benz own and live at the property at 15410 Hematite
Street. The home on the property was constructed in 1967 and the Benz's are proposing to
demolish the home and construct a new home on the property. They would like to live in the
existing home while the new one is being constructed. For a temporary period of time, there will
be two homes on the property and the Benz's have applied for an interim use permit to allow this
to happen while the new home is being constructed.

The following items are enclosed for your information:

a)
b)
c)
d)
e)

Site location map
Site Plan
New home building elevations
Proposed findings of fact
Proposed interim use permit

Notification:

In accordance with State statute, City Staff attempted to notify all owners of property within 350
feet of the Subject Property of the request for Interim Use Permit and public hearing.

Observations:

The Subject Property is approximately 3.5 acres in size and is located in the Rural Developing
area of the R-1 Residential District. The Applicants are proposing to live in the existing home on
the property while their new home is being constructed.

The proposed permit is drafted to require that the new home be constructed within 6 months, that
the applicants take occupancy of the new home within 30 days of issuance of certificate of
occupancy, and the existing home be demolished and removed within 60 days of the issuance of
certificate of occupancy for the new home. In the event the weather conditions are not conducive
to backfilling the previous house foundation and septic system, the Building Official will have
the authority to grant a maximum 60 day extension. Any extensions required beyond that time
frame must be approved by the City Council;

The Interim Use Permit will require the Applicants to post a financial surety at the City to ensure
that the old home and septic system are properly abandoned in a timely manner.
