CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT FOR A <br /> MONOPOLE COMMUNICATIONS TOWER; <br /> CASE OF CINGULAR WIRELESS, INC <br />By: Patrick Trudgeon, AICP, Community Development Director <br /> <br />Background: <br /> <br />The City has received an application fi.om Cingular Wireless to construct and operate a monopole <br />communication tower, intended to fill a gap in Cingular's wireless phone network. Staffsent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />Towers are permitted in residential districts as long as they are located in the Tower Overlay District <br />(see attached map) and are at least 10 acres in size. The subject property is located within the Tower <br />Overlay District but does not meet the minimum lot size of 10 acres. The subject property, Lot 4, <br />Block 1, Valley View Estates is approximately 9.27 acres in size. The minimum lot size in the area <br />is 10 acres. As part of the Valley View Estates plat approved in 2000, four lots were created, all less <br />than 10 acres. The original parcel was 38.7 acres and under City Ordinances were allowed to create <br />· 4 lots. The developer received a variance for Lots 1-3 for lot size and lot width. Lot 4 (the subject <br />property), was allowed to be created as a remnant parcel per City Ordinances. It should be noted that <br />when Lot 4 was created, the County requested an additional 27 feet of right-of-way to be dedicated <br />for Green Valley Rd. (CR 63). If the right-of-way is included, Lot 4 is approximately 10.3 acres. On <br />April 6, 2006, the Board of Adjustment granted a variance to the 10 acre lot size requirement based <br />on the platting history of the property. <br /> <br />In regards to the specific request, Cingular Wireless has submitted information requesting permission <br />to construct a 120' monopole communications tower. City Code allows for a maximum height of <br />120' for communications towers located in residential districts. The applicant has also submined <br />plans showing the location of the proposed tower and accessory building serving the tower on the <br />property. City Code requires a 180 foot setback from property lines in this case; the site plan <br />identifies a setback of 195 feet. <br /> <br />-231- <br /> <br /> <br />
