City Code states that no new tower shall be approved unless the Council finds that the equipment <br />planned for the proposed tower cannot be accommodated on an existing tower or building within a <br />one (1) mile radius of the proposed tower. City records do not show any communications tower <br />located within a mile of the proposed site. The applicant has provided the City information <br />regarding other towers in the area (ail over a mile from the subject property) and a coverage map <br />showing the need for the tower on the subject property. <br /> <br />The communications tower and accessory buildings will be contained in a 50' x 65' fenced in area. <br />City Code requires that all ground equipment and structures should be screened with vegetation. The <br />site plan shows the planting of seven Black Hills Spruce around the perimeter of the fencing which <br />Staff feels fulfills the screening requirement. The structure containing the equipment will be of <br />masonry construction. There would be no personnel stationed at the site and no signs will be posted <br />on the tower or equipment building except applicable warning or equipment information signs. <br /> <br />The Planning Commission conducted a public hearing on April 6; there were no comments <br />submitted relating to the request. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommends approval of the CUP request. <br /> <br />Council Action: <br /> <br />Motion by Councilmember and seconded by Councilmember to adopt <br />Resolution #06-04- adopting Findings of Fac~ relating to a request from Cingular <br />WirelesS- for a Conditional Use Permit to construct a communications tower on a portion of property <br />located at 6405 Green Valley Rd. <br /> <br />-and- <br /> <br />Motion by Councilmember and seconded by Councilmember to approve <br />Cingular's request for a Conditional Use Permit based on Findings of Fact #__ and adopt a <br />Resolution #06-04- declaring terms of same. <br /> <br />-or- <br /> <br />Motion to deny the request for a conditional use permit based on Findings of Fact # <br /> <br />Review Checklist: <br />Asst.
