City Code states that no new tower shall be approved unless the Council finds that the equipment planned for the proposed tower cannot be accommodated on an existing tower or building within a one (1) mile radius of the proposed tower. City records do not show any communications tower located within a mile of the proposed site. The applicant has provided the City information regarding other towers in the area (ail over a mile from the subject property) and a coverage map showing the need for the tower on the subject property. The communications tower and accessory buildings will be contained in a 50' x 65' fenced in area. City Code requires that all ground equipment and structures should be screened with vegetation. The site plan shows the planting of seven Black Hills Spruce around the perimeter of the fencing which Staff feels fulfills the screening requirement. The structure containing the equipment will be of masonry construction. There would be no personnel stationed at the site and no signs will be posted on the tower or equipment building except applicable warning or equipment information signs. The Planning Commission conducted a public hearing on April 6; there were no comments submitted relating to the request. Recommendation: The Planning Commission recommends approval of the CUP request. Council Action: Motion by Councilmember and seconded by Councilmember to adopt Resolution #06-04- adopting Findings of Fac~ relating to a request from Cingular WirelesS- for a Conditional Use Permit to construct a communications tower on a portion of property located at 6405 Green Valley Rd. -and- Motion by Councilmember and seconded by Councilmember to approve Cingular's request for a Conditional Use Permit based on Findings of Fact #__ and adopt a Resolution #06-04- declaring terms of same. -or- Motion to deny the request for a conditional use permit based on Findings of Fact # Review Checklist: Asst.
