Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Ordinance #06- <br />10 to vacate the drainage and utility easements contained on Lot I, Block 1, Ramsey Town <br />Center Addition 3ra Addition, with authorization for the City Attorney to amend verbiage in the <br />legal description included in the ordinance. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamec: aye <br />Councilmember Cook: aye <br />Councilmember Elvig: absent <br />Councilmember Jeffrey: absent <br />Councilmember Olson: aye <br />Councilmember Pearson: aye <br />Councilmember Strommen: aye <br /> <br />Motion carried. <br /> <br />Case//7: Adoption of Ordinance to Vacate Drainage and Utility Easement in <br /> Highlands at River Park 4th Addition, Case of Jason Peterson <br /> <br />Community Development Director Trudgeon advised Jason Peterson of Maple Leaf Custom <br />Homes is requesting an administrative subdivision to realign a common property line between <br />two lots that he owns. The purpose of this administrative subdivision is to increase the area of <br />Lot 10 to accommodate an in-ground pool in the backyard. Maple Leaf Custom Homes currently <br />owns both lots, and seeks to make the adjustment. The proposed change will add approximately <br />2,380 square feet to Lot I0. Both lots will remain in conformance to City Code. Maple Leaf <br />will be required to provide the City with a replacement easement along the new common <br />property line. The existing easements on the common property line of Lots 9 and 10, Block 1, <br />will be vacated and a new easement will be taken on the new property line. <br /> <br />Community Development Director Trudgeon explained the public hearing to vacate easements <br />was held at the City Council meeting on February 28, 2006. One resident spoke and wanted to <br />make sure that any house built on Lots 9 and 10 would be able to fit on the reconfigured lots. <br />Staff explained that new parcels created from the administrative subdivision will be able to meet <br />the required setbacks. Mr. Trudgeon advised staff recommends adoption of the ordinance to <br />vacate the existing easements. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Ordinance <br />#06-11 to vacate the easement for drainage and utility purposes along the common property line <br />for Lot 9, Block 1 Highlands at River Park 40' Addition and Lot 10, Block I, Highlands at River <br />Park 4th Addition. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamec: aye <br />Councilmember Cook: aye <br /> <br />City Council / April 11, 2006 <br /> Page 17 of 26 <br /> -79- <br /> <br /> <br />
