Councilmember Cook stated there are two issues the Council wants to work out during this <br />moratorium; one being the greenspace and open space, and the second being the management of <br />the community septic system, which is addressed in condition no. 4. He stated he likes this plan <br />and thinks there are benefits to the City in going forward with this application at this time. He <br />requested input from the applicant regarding the five contingencies recommended by staff, in <br />particular to the fourth contingency of a professional management finn overseeing the well and <br />septic system. <br /> <br />Steve Slettner, President of Technical Design representing Kelly Acres and Rum River Prairie, <br />stated the applicants concur with the staff report as revised on April 5, 2006. <br />Regarding access to existing homes off of the proposed street, that is minor and has been <br />addressed as part of the plan. Park fees are being required and will be paid as part of the total 30 <br />units. With regards to MPCA approval of the septic system, they have submitted the plans to <br />MPCA. The soils are perfect for this type of system. They do not plan on having a homeowners <br />association nm a septic system, as they are not equipped and do not know about this type of <br />maintenance program. Connexus Energy has a division that manages most of these systems in <br />this area. The management of the system will be turned over to a firm with expertise; however, <br />they have not determined who it will be at this time. With regards to the outlots that are shown, <br />the applicants understand they cannot do anything with the rest of that land until sewer comes to <br />that area. Mr. Slettner stated unlike the other cluster development that was brought before the <br />Council, these applicants are not asking for any variances from the existing cluster ordinance. <br />They have paid attention to staff and listened to their report. They acted quickly to the closing <br />off of Wolverine Street and the access onto Tiger Street. With regard to water services, they will <br />work through that. What they propose and the Public Works Department would like to see, are <br />slightly different in concept, and they will get through that. That is the only issue at this point; <br />everything else has been accepted and agreed to. <br /> <br />Councilmember Cook stated his decision hangs with the requirement to have a finn that knows <br />what they are doing overseeing the septic system, and taking the proper money to be sure it <br />functions as it should with repairs and replacement in the future so it is always guaranteed to be a <br />workable system. <br /> <br />Mr. Slettner stated with regards to the greenspace and park requirements, he believes the rest of <br />the property on the other side of Armstrong Boulevard for the National Growth development will <br />be an outlot. When that outlot is platted it will be required to meet the single-family residential <br />zoning requirements at that time. If the Council would like to include a requirement that states <br />the overall acreage that is part of this is what it sits at today, that would be an acceptable part of <br />the contingency that can be followed through. When the outlot comes in for platting if it is still <br />just a park fee requirement it will be calculated at the rate at that time. If greenspace will be <br />required he believes that is acceptable to all the parties. Regarding Councilmember Olson's <br />concern of losing out on some of the acreage for greenspace, his thought is this outlot is part of <br />the plat; they can have the acreage of the outlot and could put a note on the plat of the overall <br />acreage so it would meet the requirements in the future. They cannot know at this time that the <br />R-1 zoning requirements will be the same in 2020 as they are today. The things the Council is <br />wrestling with now with R-I and park requirements might change.
