("BU~LIi~GT~Ji; <br />is a Delaware railroad corporation which owns and <br />railway system throughout the State of Minnesotd and <br /> a portion of its railway lines runs through the CITf <br /> <br />of Ramsey. <br /> 3. The Minnesota Uepartment of Transportation ("H~4 <br />DOT"), is the agency of the State of Hinnesota which is char~ed <br />with the responsiblity of regulating by permit, access to the <br /> <br />trunk highway system in the State of Minnesota. <br /> 4. North Fork Inc._ ("NORT~ FORK"), is a Hinnesota <br />corporation and is the o~.~ner of 1,250 acres of land in the CITY <br />of Ramsey, which property is adjacent and immediately north of <br />the BURLINGTON ~iORTHERN mainline tracks. <br /> <br /> C. STANDING OF PA~TIES IN THESE PROCEEDINGS. <br /> 5. The CITY by its resolution #~7-~20 entitled <br />"Resolution Petitioning the MinnesOta Department of <br />Transportation for the Establishment of a Railroad Crossing" <br />dated ~ugust 19, 1987, commenced the proceeding for a public <br />railroad crossing at the location known as the Dayton crossing as <br />well as to establish a new permanent access ontO U.S. ~ignway <br /> <br />10. <br /> 6. BURLINGTON i4uRTHERN, by its application dated <br />October 20, !987 and filed October 29, 1967, filed a petition <br />with the BOARD to close the public grade crossing at Puma Street <br />in the CITY, citing the need to close the crossing for "the <br /> <br />promotion of public safety and convenience <br /> 7.
