a dangerous dog is being harbored or cared for in <br /> violation of SubSections (1), (2), (3), and (4) <br /> above, the police officer or animal control officer <br /> may petition a court of competent jurisdiction to <br /> order the seizure and impoundment of the dangerous <br /> dog pending trial. In the event that a police <br /> officer or animal control officer has probable <br /> cause to believe that a dangerous dog is being <br /> harDored or housed in violdtion of ~ec%ion <br /> above, the police officer or animal control offier <br /> may seize and impound the dangerous dog pending <br /> trial. <br />110.~316 Failure to Restrain an attack by a uo§. It shall be <br />unlawful for an o~ner to ~ai~ ~o restrain a ~og fro~ <br />inflicting or attempting to inflict bodily in2u y to any <br />person or other animal. Violation of this section shall be a <br />misdemeanor. The Court upon a finding of the defendant's <br />guilt hereunder, is authorized to order, as part of the <br />disposition of the case, that the animal be destroyed based <br />on a uritten order containing one or more of the fotlo~¢ing <br />findings of fact: <br /> <br />1. The animal is dangerous as demonstrated by a vicious <br /> attack, an unprovoked attack, an attack witi~ou% warning, <br /> or ~ultiple attacks; or <br /> <br />2. The owner of the animal has demonstrated an indbility <br /> or unwillingness to control the ani~.~al in order to <br /> prevent injury to per'<ons, or oti~er animal. <br /> If the Court does not order the destruction of the dog, the <br /> Court, as an alternative, may order the defendant to provioe, <br /> and show proof to the Court of public liability insurance ~n <br /> the minimu~ amoun~ of $3uU,OOO.UO. <br /> 110.0317 Stopping an Attack. If any Police t}fficer or Animal <br /> Control u~:¥icer is witness to an attack by a do9 upon a <br /> person or another animal, ti~e officer ~.~ay take ~,,~atever me~ns <br /> he or she deems appropriate to bring the attack to an end and <br /> preve,~t further injury to ~he victim. <br /> 110.0318 Uogs Disturbing the Peace. It shall be unla~ful for <br /> any person to own, keep, have in possession, or harbor any <br /> dog which howls, yelps, or barks to the reasonable annoyance <br /> of another person or persons. Any person violating this <br /> section, who upon first requested by a ~olice Dfficer or <br /> Animal Control Officer to stop or prevent the annoyance, and <br /> refuses t~ comply ~ith the request ~ill be issued a citation <br /> or arrested in accordance with Minnesota Rules of Criminal <br /> Procedure, ~nd, if the officer deems it necessary to stop the <br /> annoyance, may have the dog taken to t~e City animal pound. <br /> Any dog placed in the pound may be reclaimed by the o'..~ner <br /> upon payment of the fee presecribed in Section 110.0~, and <br /> <br /> <br />
