CASE ~4: <br /> <br />15 Minutes <br /> <br /> R~QUEST FOR O0hDITIONAL uSE P~IRMIT <br /> TO CON.%'I'K~ AN ADV~ISING SIGN; <br /> CASE OF B~k~z.y OUTDOCR, INC. <br />Anne Norris, Co~m~mity Develotrnent Director <br /> <br />Background: <br />Breezy Outdoor, Inc. is requesting a conditional use permit to construct an <br />advertising sign at 7009 Highway ~10 N.W. This property is owned by Mr. Larry <br />Rudesill. The proposed sign will be located approximately five feet from the <br />property line. This property is approximately one acre in size. The sign is <br />proposed to be constructed with two faces, each approximately 300 square feet <br />in area. <br />Section 170.054 of the City Code states that free standing advertising signs <br />shall be permitted on parcels where the subject activity is located or within <br />2,500 feet of the parcel on which the subject activity is located. In any <br />case, no advertising signs may be constructed without a conditional use permit. <br /> <br />Enclosed are the following it~ns for your information: <br /> <br />a) Application <br />b) Site location map <br />c) Sign specifications for proposed sign <br />d) Section 170.054 of the City Code <br />e) Proposed findings of fact <br />f) Proposed conditional use permit <br />g) Letter from Breezy Outdoor dated February 11, 1988 <br />h) Planning and Zoning Commission public hearing and regular meeting <br /> minutes dated February 2, 1988 <br /> <br />Observations: <br /> <br />The Planning and Zoning Commission held a'p'ublic hearing on this request on <br />February 2, 1988. At that time, the Commission tabled action on this request <br />until Breezy Outdoor, Inc. provided information r~arding the subject matter to <br />be advertised on the sign. Cn Februa:y 12, 1988 City Staff received a letter <br />frcra Breezy Outdoor, Inc. stating that they could not provide this information <br />to the Commission as the sign content will change periodically. Breezy <br />Odtdoor, Inc. also requested that their conditional use permit request be <br />forwarded directly to the City Council. <br /> <br />Tne City Attorney has interpreted Section 170.054 of the City Code to mean that <br />no advertising signs may be constructed in the City unless such signs advertise <br />some activity on the subject property or within 2,500 feet of the subject <br />property. <br /> <br />As you may recall, in 1987 the Council reviewed Ms. Jim Franklin's request for <br />a conditional use permit to oonstruct an advertising sign on U. S. Highway ~.10 <br />~nd tabled action on the request pending the completion of the Highway ~10 <br />Corridor study. <br /> <br /> <br />
