COMMISSION BUSINESS <br /> <br />Case #1: Park Dedication for Shade Tree Creek <br /> <br />It was noted Shade Tree Communities, LLC has submitted the preliminary plat for Shade Tree <br />Creek. This is a proposed cluster development located south of 177th Avenue and Erkium Street. <br />The cluster ordinance allows for development in areas not currently served by sewer by requiring <br />urban size lots, common water and sewer systems for the development. The number of lots that <br />can be developed at this time is based on the requirement of 2.5 acres per unit which is 16 lots. <br />The remainder of the parcel will be platted as outlots, further development will not occur until <br />city sewer and water is extended to the site. <br /> <br />This plat adjoins Riverbrook Addition which was platted several years ago. The southwest <br />comer is common with the northeast comer of a conservation easement anticipated to be <br />acquired by the City along the north side of Trott Brook. The development is in the Rogers Lake <br />Recreation District. The Rum River Central County Park is on the east side of the District. <br /> <br />Civil Engineer 1I Linton reviewed the staff report with the Commission. <br /> <br />Civil Engineer II Linton stated they were looking at having the developer dedicate a strip of land <br />in the southwest comer of the site for park dedication at this time. A conservation easement is <br />being negotiated over the parcel on the site. This will provide an area for a ten foot trail across <br />the development. <br /> <br />Commissioner Olds wondered if there was currently a street going there or was that from the <br />previous development. <br /> <br />Civil Engineer 1/Linton indicated the road was being proposed. <br /> <br />Chairperson Johns wondered if the trail would connect to the diagonal road through the <br />development. <br /> <br />Civil Engineer II Linton explained it would. <br /> <br />Chairperson Johns wondered how the credit portion of .25 acres works. <br /> <br />Civil Engineer II Linton stated when there is development; there would be .25 acres of land in <br />credit if the developer wanted it. He noted he did talk to a representative of the development and <br />there was no indication they did not want to do this. <br /> <br />Motion by Commissioner Shryock, seconded by Commissioner Olds, to recommend Park <br />Dedication be fulfilled by land dedication with a credit for future requirements of 0.25 acres and <br />to recommend trail dedication in cash and to recommend that staff be directed to sort out a <br />drainage utility easement or a ten foot trail with a five foot boulevard. <br /> <br />Park and Recreation Commission/February 9, 2006 <br /> Page 2 of 5 <br /> <br /> <br />
