The communications tower and accessory buildings will be contained in a 50' x 65' fenced in area. City Code requires that all ground equipment and structures should be screened with vegetation. The site plan shows the planting of seven Black Hills Spruce around the perimeter of the fencing which Staff feels fulfills the screening requirement. The structure containing the equipment will be of masonry construction. There would be no personnel stationed at the site and no signs will be posted on the tower or equipment building except applicable warning or equipment information signs. The Planning Commission conducted a public hearing on April 6; there were no comments submitted relating to the request. The Planning Commission recommends approval of the CUP request. At their April 25, 2006, the City Council raised concerns about the location and its impact to the surrounding neighborhood. They also expressed a desire to look at the possibility in locating the tower on public land. Subsequently, the City Council tabled action on the request to give time for the City and the Applicant to meet and discuss the possibilities of locating the tower on public land. Recommendation: Staff will be meeting with representatives of Cingular Wireless prior to the City Council meeting. Staff will bring forward a recommendation to the City Council at the May 9, 2006 meeting. Council Action: Motion'by Councilmember ar~/:l seconded by Councilmember to adopt Resolution #06-04- adopting Findings of Fact~ relating to a request from Cingnlar Wireless for a Conditional Use Permit to construct a communications tower on a portion of property located at 6405 Green Valley Rd. -and- Motion to deny the request for a conditional use permit based on Findings of Fact # -Or- Motion by Councilmember and seconded by Councilmember to approve Cingnlar's request 'for a Conditional Use Permit based on Findings of Fact # and adopt a Resolution #06-04- declaring terms of same. ~ Review Checklist: City Admini~rator Asst.
