Motion by Commissioner Levine, seconded by Commissioner Cleveland, to recommend that <br />City Council adopt Findings of Fact relating to a request from Cingular Wireless for a <br />conditional use permit to construct a communications tower on a portion of property located at <br />6405 Green Valley Road. <br /> <br />Motion Carded. Voting Yes: Chairperson Nixt, Commissioners Levine, Cleveland, Brauer, <br />Hunt, and Trites Rolle. Voting No: None. Absent: Commissioner Van Scoy. <br /> <br />Case #2: <br /> <br />Public Hearing - Request for Interim Use Permit to Maintain Two Dwellings <br />on One Parcel; Case of Michael and Nancy Bcnz <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:51 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public heating to order at 7:51 p.m. <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik explained that the City Code states that there <br />shall not be more than one main building on a lot unless otherwise provided for in City Code. <br />Mr. and Mrs. Benz own and live at the property at 15410 Hematite Street. The home on the <br />property was constructed in 1967 and the Benz's are proposing to demolish the home and <br />construct a new home on the property. They would like to live in the existing home while the <br />new one is being constructed. For a temporary period of time, there will be two homes on the <br />property and the Benz's have applied for an interim use permit to allow this to happen while the <br />new home is being constructed. <br /> <br />Assistant Community Development Director Frolik stated staff is recommending approval of the <br />Interim Use Permit. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Commissioner Levine, seconded by Commissioner Nixt, to close the public hearing. <br /> <br />Planning Commission/April 6, 2006 <br /> Page 5 of 14 <br /> <br /> <br />
