Community Development Director Trudgeon replied the cost would be the responsibility of the <br />City, as there are limitations included in the purchase of the fight-of-way unless the property is <br />subdivided. <br /> <br />Mayor Gamec stated if this is turned into a City street the cost should be paid by the City; the <br />property owners should not be assessed for this situation. <br /> <br />Councilmember Cook concurred. He stated this right-of-way is now City property, and should <br />be maintained by the City. <br /> <br />Mayor Gamec inquired about the current condition of the road. <br /> <br />Public Works Director Kapler replied the road is in reasonably good shape. However, if this is <br />to become a City road it should be brought up to City standards. <br /> <br />Loft Kaas, 7155 - 160th Lane NW, stated the developer pays when a road is needed to access <br />homes that are being built. She questioned if a precedent would be set by the City building a <br />road to access one house. <br /> <br />Councilmember Cook replied a developer pays for roads within a development; many times the <br />City pays for roads up to a development. <br /> <br />Ms. Kaas questioned where the future development would be that this road would access. <br /> <br />Greg Bauer, 7211 160th Avenue NW, stated any parcel being split is required to provide a ghost <br />plan. He provided that ghost plan with the permit for his property. <br /> <br />The consensus of the Council was to direct staff to proceed with the required process to upgrade <br />the 160th Lane right-of-way to a City street. <br /> <br />Community Development Director Trudgeon indicated staff will review the Capital <br />Improvement Plan process and begin programming and identifying funding sources for the <br />upgrade of the road. <br /> <br />Mayor Gamec directed staffto remain in contact with the residents regarding the process. <br /> <br />Councilmember Elvig inquired if there are any safety issues with the current status of the road. <br /> <br />Public Works Director Kapler replied he has visited the site after a snow and the current property <br />owner is taking very good care of the driveway. The maintenance of the road is not an issue, but <br />the City is having a private person maintaining the road. <br /> <br />The Council discussed possible liability issues associated with emergency access until the right- <br />of-way is turned into a City street, and whether a no-parking sign should be posted on the road. <br /> <br />City Council Work Session / February 7, 2006 <br /> Page 5 of 11 <br /> <br /> <br />
