1. That Ramsey will issue to Phelps a variance in recordable form granting <br />Phelps a variance to Ramsey Code Section 170.0314B such that one, building permit for <br />a single family residence can be issued on the following described property, to-wit: <br /> That part of Government Lot 4, Section 1, Township 32, Range 25, <br /> Anoka County, Minnesota; lying North of Trott Brook. <br />The above does not preclude the issuance of additional building permits for accessaD' <br />structures to said residence, providing that they comply with the then existing city code <br />regulations. <br /> 2. That Phelps agrees on behalf of himself, his heirs and assigns to hold Ramsey <br /> harmless from any and all causes of action relating to the inability of emergency <br /> vehicles to use the private driveway to his residence as described above. <br /> 3. That access to said Government Lot 4 shall be by the following legally <br /> described private easement, to-wit: <br /> The West 66 feet of the East 250.81 feet of the Northwest Quarter <br /> (NW-1/4) of the Southwest Quarter (SW-1/4) of Section 1, Township 32, <br /> Range 25, Anoka Count),, Minnesota. <br /> 4. That Phelps, his heirs and assigns, shall be unable to subdivide said <br /> Govermment Lot 4 unless and until Ramsey's subdivision regulations are fully complied <br /> Mth and under no circumstances will more than one residential unit be permitted to <br /> use as access the private easement above described. <br /> <br /> .
