Commissioner Shumway recalled that two gentlemen at the July 7 public <br />hearing did not object to the rezoning if one-half the preperty was to be <br />maintained as residential and if there would be some control over the type <br />of use allowed on the business portion of the property. <br /> <br />Ms. Norris noted that if the property is rezoned to B-l, any permitted use <br />under that zone would be allowed. <br /> <br />Discussion ensued regarding the fact that a conditional use permit would <br />retain the City's control over the type of use that would be permitted on <br />the northern portion of the parcel. <br /> <br />Commissioner LaDue noted that the subdivision would create two substandard <br />lots. <br /> <br />The Commission reviewed the proposed alignment, right-of-way and setbacks <br />for the the Front Street improvements. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Howell to <br />recommend denial of Mr. Dennis Holmquist's request for a metes and bounds <br />subdivision and rezoning as it would create two substandard lots, result in <br />no control over the type of use that would be permitted, and it create a <br />lot with improper access or easement. <br /> <br />Further Discussion: Chairman Shumway noted that even with a conditional <br />use permit, there would be the problem of substandard lot sizes and <br />improper access. Commissioner Howell noted that if 50 feet had not been <br />deeded for Front Street improvements, Mr. Holmquist would not have a <br />problem. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />Hendriksen and Terry. Voting No: Commissioners LaDue and Howell. Absent: <br />Commissioner Holm. <br /> <br />Commissioner Howell stated that his reason for voting 'no' is that he feels <br />the City is trying to develop that area along both sides of Front Street as <br />business and the Commission's motion to recommend denial to rezone Mr. <br />Holmquist's parcel is hampering that effort. <br /> <br />The Commission requested that a future agenda item be to review the Front <br />Street area, once the improvements are complete, for any adjustments to <br />minimum lot sizes that may be necessary. <br /> <br />Case 012: Recuest For Metes And Bounds Subdivision: Case Of Tiller <br /> CorDoration: <br /> <br />Motion by Commissioner Howell and seconded by Commissioner Hendriksen to <br />table this case until later in the meeting when the applicant is present. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />Hendriksen, Howell, LaDue and Terry. Voting No: None.
