_;-ion by Commissioner Zimmerman and seconded by Commissioner Holm to <br />change Item #16 to read as follows: 'That if the variance is granted, it <br />} may be materially detrimental to the purposes of the Zoning Chapter.' <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Holm, Terry and LaDue. Voting No: None. Absent: Commissioners <br />Hendriksen and Howell. <br />Motion by Commissioner Zimmerman and seconded by Commissioner Holm to add <br />Item #18 to read as follows: 'That upon review of the circumstances, the <br />Board of Adjustment cannot determine that a hardship exists in the <br />Applicant's case.' <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Holm, Terry and LaDue. Voting No: None. Absent: Commissioners <br />Hendriksen and Howell. <br />Notion by Commissioner Terry and seconded by Commissioner LaDue to adopt <br />Findings of Fact 0201, as amended, relating to Mr. George Pepek's request <br />for a variance. (Please refer to findings of fact file for Findings of <br />Fact 0201). <br />Notion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Holm, Terry and LaDue. Voting No: None. Absent: Commissioners Howell <br />and Hendriksen. <br />Motion by Commissioner Zimmerman and seconded by Commissioner Holm to deny <br />Mr. George Pepek's request for a variance based on the findings of fact. <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Holm, Terry and LaDue. Voting No: None. Absent: Commissioners Howell <br />and Hendriksen. <br />Mr. Pepek reiterated that he feels the drainfield location is the hardship. <br />Chairman Shumway stated that the laws relating to variances are rather cut <br />and dry; the drainfield location is a man-made problem. <br />Case #2: Reauest For Variance From Section 170.076.18 Of The City Code <br />To Exceed The Amount Of Imoervious_ Surface _Coverage, Case Of <br />Amoco Oil Company And North Star Engineering_ <br />Mr. Kris Kristufek of Amoco Oil and Mr. James Hansen of Commercial Sites of <br />Minnesota were present requesting a variance to the Scenic River Overlay <br />District 30% impervious surface coverage restriction of 30 %; the site plan <br />for the Amoco Oil Company includes a 58% impervious surface coverage. <br />Mr. Kristufek noted that the sole applicant in this case is Amoco Oil <br />Company. <br />Notion by Commissioner LaDue and seconded by Commissioner Terry to adopt <br />Findings of Fact 0202, amended as follows, relating to Amoco Oil Company's <br />request for a variance: (Please refer to findings of fact file for <br />Board of Adjustment /April 27, 1988 <br />Page 3 of 4 <br />
