1 (1) For every one significant tree inch that is removed in excess of the removal threshold, the <br />2 developer shall replant 1.25 inches (-diameter caliper) of new trees or provide the city with <br />3 $125.00 in restitution. <br />4 {-2) SigRif+cant trees removed for water quality trc tmcnt pe-n-ds, public trails and sidewalk, and <br />5 arterial and collector stre-cts, or that are -considered invasive specie, arc exempt fmom the <br />6 removal threshold calculatie-n, <br />7 (G) Reforestation/restitution plan. <br />8 (1) If the total number of significant tree inches to be removed exceeds the removal threshold, <br />9 the developer shall provide a reforestation plan -(can be included as part of landscaping plan, <br />10 t must el -early identify those tree that arc intended to satisfy thc rcforcstatie- <br />11 requirement), or a calculation of restitution, or a combination thereof. <br />12 (2) A reforestation plan shall be prepared by a registered landscape architect or forester and shall <br />13 comply with the following criteria: <br />14 a. The plan shall indicate the location and diameter (or height if coniferous; for each three <br />15 (3) feet in height is equivalent to one (1) caliper inch) of all reforestation trees to be <br />16 planted. This can be included on the landscape plan, but the reforestation calculation, <br />17 trees, and inches, must be specified. <br />18 b. Size at the time of planting shall comply with the planting standards outlined in the <br />19 respective zoning the applicable landscape standards for the respective zoning district. <br />20 c. No more than 25 percent of the reforestation trees te-bc planted shall be from any one <br />21 species. <br />22 d. Reforcstatieft Replacement trees included in the reforestation plan may count toward <br />23 the trees required by the city's landscaping regulations. base landscaping requirements <br />24 trccs required for land&caping purposes within thc applicable zoning -district <br />25 e. Restitution, if applicable, shall be paid in cash to the city prior to the release of the final <br />26 plat mylars for recording, —or prior to approval of a minor subdivision, or, if a plat was <br />27 not required, prior to the issuance of a building permit subject to site plan review. Any <br />28 restitution paid shall be deposited in the community reforestation fund and be used for <br />29 reforestation efforts within the city. <br />30 (H) Protection from disease and pestilence. All clearing in oak stands shall be performed prior to April <br />31 15 or after July 15 of each season. Any development involving oak trees on or adjacent to the <br />32 development area must submit a plan in conjunction with the preliminary plat that identifies what <br />33 precautionary steps will be taken to protect the trees from oak wilt. <br />34 (I) Encroachment. If encroachment into a tree preservation area occurs that causes irreparable <br />35 damage to a tree(s), the tree preservation plan shall be revised to compensate for the loss. Under <br />36 no circumstance shall the developer be relieved of responsibility for compliance with the provisions <br />37 of this division, nor shall planned revision activities prevent the city from instituting action for <br />38 violation of this division. <br />39 j) Planting requirement. The -quantity of the required plantings shall bc in accordance with the performance standards <br />42 established for the respective zoning -district <br />43 {1) Size of tree at planting. For all required planti-ng-sel-e-ei-el-td-e-u-s-t-Fees shall lac a minimum of <br />44 one inch caliper at time-ef plantingl evergreen trees shall bc a minimum of five feet in <br />45 height at time-ef planting. S-ppeccifi-cati-ons shall bc determined by thc American Nurseryman's <br />46 Standards. <br />47 {2) Type of trcc stock.
