Tre,cs shall bc planted a minimum of two fcct from any joint <br />13 utility trench whenever practicable. <br />14 Sec. 117 328. !-la:ardour andlor nuisance trees <br />15 Thc city shall have thc right to-causc thc rcmoval of any dead or diseased trccs on private property within <br />16 thc city, whcn such trccs constitute a hazard to life or property, or harbor insccts or discasc which <br />17 eonstitutc a petcntial threat to othcr trccs within the-ei-ty. In thc event of failurc of owncrs te-eomply with <br />18 Bch provision, the-ei-ty shall have thc authority to remove such trees and-chargc thc cost of rcmoval to <br />19 thc property owncr. <br />20 {1) Noticc to take action. An order for a "Noticc to Takc Action" will be issue-d upon dctcrminatie- <br />21 by thc city, or its designee, that maintenance work requiring the pruning, preservation, or <br />22 rcmoval of trccs or plants upon privatc property whcn such aet+on is ne-ecssary to ensure <br />23 public safety and/or to prevent thc spread of disease or insects to public trees and places. <br />24 a. Such notice shall describe thc kind of trcc, shrub, or othcr plant ef-plant part w-I4ch has <br />25 been declared to bc a public nuisance; its location on thc property; and thc reason for <br />26 declaring it a nuisance <br />27 b. Proper disposal procedures of wood, bark and debris from said nuisance shall be <br />28 detailed in said notice. Thcsc disposal procedures shall bc followed within the time <br />29 provided in thet+c-e, <br />30 •c. Thc notice of violation shall state thc specific violation and indicate whether immediate <br />31 enforcement will bc sought or if 30 days will bc allowed to correct and rcmovc thc <br />32 v+oIatien, <br />33 •d. If thc owncr of thc property to whom an e-Fel-cr has be -en issue fails or rcfuscs to take <br />34 remedial act+on in accordance with and -within thc time specified in an ewer, the -city <br />35 or its dcsignatc shall cause thc remedial aet+on sa ordered to bc performed at the <br />36 expense of the owncr. Appeals shall bc in accordance with section 117 55. <br />37 {2) Disease or pest infested trccs. Any trcc located within thc city, which is determined by a <br />38 certified arborist to bc afflicted with any dangerous or infectious insect infestation -or plant <br />39 discasc, may bc declared a pub-lic nuisance. This shall include trees and shrubs harboring <br />40 injurious insects or pathogens that m-a-y-causc significant potential danger to thc community <br />41 forest. <br />42 a. Thc city or its dcsignatc may rcmovc or cause or order to bc removed, any trcc or part <br />43 thereof which is in an unsafe condition or which by reason of its nature is injurious to <br />44 sewers, c cr lines, gas lines, water lines, or othcr public improvements, or i1 <br />45 infected with Oak Wilt or Dutch Elm Disease. <br />46 b. An evaluation-ef "imminent danger" means that thc hazard to thc public is immediate.
