1 c. In addition to the conditional use permit requirements of section 920(C)(4), criteria for <br />2 considering whether to grant a conditional use permit for structures exceeding the <br />3 height limits must include: <br />4 1. Assessment of the visual impact of the proposed structure on public river corridor <br />5 views, including views from other communities; <br />6 2. Determination that the proposed structure meets the required bluff and OHWL <br />7 setbacks; <br />8 3. Identification and application of techniques to minimize the perceived bulk of the <br />9 proposed structure, such as: <br />10 (i) Placing the long axis of the building perpendicular to the river; <br />11 (ii) Stepping back of portions of the facade; <br />12 (iii) Lowering the roof pitch or use of a flat roof; <br />13 (iv) Using building materials or mitigation techniques that will blend in with the <br />14 natural surroundings such as green roofs, green walls, or other green and <br />15 brown building materials; <br />16 (v) Narrowing the profile of upper floors of the building; <br />17 (vi) Increasing the setbacks of the building from the Mississippi River or <br />18 blufflines; <br />19 (vii) Identification of techniques for preservation of those view corridors <br />20 identified in the MRCCA plan; and <br />21 (viii) Opportunities for creation or enhancement of public river corridor views. <br />22 (3) Structure and impervious surface placement. <br />23 a. Structures and impervious surface must not be placed in the shore or bluff impact zones <br />24 unless identified as an exemption in section 920(L). <br />25 b. Structures and facilities must comply with the following OHWL setback provisions <br />26 unless identified as exempt in section 920(L): <br />27 1. ROS District: 200 feet from the Mississippi River. <br />28 2. RN District: 100 feet from the Mississippi River and 75 fcct from the Rum River. <br />29 c. Structures and facilities must comply with the following bluffline setback provisions <br />30 unless identified as exempt in section 920(L): <br />31 1. ROS District: 100 feet. <br />32 2. RN District: 40 feet. <br />33 3. SR District: 40 feet. <br />34 d. Where principal structures exist on the adjoining lots on both sides of a proposed <br />35 building site, the minimum setback may be altered to conform to the average of the <br />36 adjoining setbacks, provided that the new structure's scale and bulk riverward or <br />37 bluffward of the setbacks required under section 920(F)(3) consistent with adjoining <br />38 development.
