Subsurface sewage treatment systems, including the septic tank and absorption area, <br />3 must be located at least 75 feet from the ordinary high water level of the Mississippi <br />4 River and all other public waters. <br />5 (4) Lot size and buildable area. <br />6 a. The width of lots abutting the Mississippi River in the ROS District must be at least 200 <br />7 feet, unless alternative design methods are used that provide greater protection of the <br />8 riparian area. <br />9 b. All new lots must have adequate buildable area to comply with the setback <br />10 requirements of section 920(F)(3) so as to not require variances to use the lots for their <br />11 intended purpose. <br />12 (G) Performance standards for private facilities. <br />13 (1) Purpose. To establish design standards for private facilities that are consistent with best <br />14 management practices and that minimize impacts to primary conservation areas, public river <br />15 corridor views and other resources identified in the MRCCA plan. <br />16 (2) General design standards. All private facilities must be developed in accordance with the <br />17 vegetation management and land alteration requirements in sections 920(1) and 920(J). <br />18 (3) Private roads, driveways, and parking areas. Except as provided in section 920(L), private <br />19 roads, driveways and parking areas must: <br />20 a. Be designed to take advantage of natural vegetation and topography so that they are <br />21 not readily visible; <br />22 b. Comply with structure setback requirements according to section 920(F)(3); and <br />23 c. Not be placed within the bluff impact zone or shore impact zone, unless exempt under <br />24 section 920(L) and designed consistent with section 920(F)(2). <br />25 (4) Private water access and viewing facilities. <br />26 a. Private access paths must be no more than: <br />27 1. Eight feet wide, if placed within the shore impact zone; and <br />28 2. Four feet wide, if placed within the bluff impact zone. <br />29 b. Private water access ramps must: <br />30 1. Comply with Minnesota Rules, chapters 6115.0210 and 6280.0250; and <br />31 2. Be designed and constructed consistent with the applicable standards in Design <br />32 Handbook for Recreational Boating and Fishing Facilities. <br />33 c. Design and construction of private stairways, lifts, and landings are subject to the <br />34 following standards: <br />35 1. Stairways and lifts must not exceed four feet in width on residential lots. Wider <br />36 stairways may be used for commercial properties and residential facilities held in <br />37 common, if approved by conditional use permit; <br />Page 107 of 160 <br />
