1 (6) To defray the administrative costs of processing requests for an amendment to this <br />2 subdivision, a fee not exceeding administrative costs shall be paid by the petitioners. Such fee <br />3 shall be determined by the council. <br />4 Conditional use permit review. <br />5 (1) A copy of all notices of any public hearing, or where a public hearing is not required, a copy <br />6 of the application to consider issuance of a conditional use permit shall be sent so as to be <br />7 received by the commissioner at least 30 days prior to such hearings or meetings to consider <br />8 issuance of a conditional use permit. A copy of the decision shall be forwarded to the <br />9 commissioner within ten days of such action. <br />10 {2) Conditional use -permits relating to private or comme-Fcial rccrcational development must be <br />11 certified in accordance with subsection (g) of this section. <br />12 {-C) Certification. <br />13 {1) Gcrtain land usc decisions which directly affect the usc of land -within the Scenic River Land Use <br />14 District and involve any of thc following actions must bc certified by thc commissie+-er a� <br />15 specified in subsection (g)(2) of this section. <br />16 a. Adopting or am dinancc regulating e-ef lan oning-ef particular <br />17 tracts of the land <br />18 b. Granting a variance from a provision of this subdivision that related to thc zoning dimension <br />19 provisions of section 117 256 and any other zoning-dime+t-s+on provisions cstablished in Minn. <br />20 cs pts. 6405.1400-6105.1590, <br />21 c. Appreving a plat that is ineonsistcnt with the local land usc. <br />22 d. Granting a conditional use -permit for a private or commercial rccrcational development. <br />23 (2) Certification process. <br />24 a. A copy of all notices of any publie-karings, or where a public hearing k n-e-t re-q-uired, a copy <br />25 of the application to consider zoning amendments, variances, or ineonsistcnt platy under local <br />26 code shall bc sent so as to bc received by thc commissie�er at least 30 days prior to sued <br />27 i-carings-or meetings to consider such aet+ons. The notice of application shall include a copy <br />28 of thc proposcd ordinance -or amendment, or a copy of thc proposcd inconsistent plat, or a <br />29 description of thc requested varianeeor a copy of thc conditional use -permit application, <br />30 where applicable. <br />31 b. The-ei-ty shall notify thc commissioner of its final decision on the proposcd action within te-t <br />32 days of thc decision. <br />33 •c. The action becomes effective when and only when either: <br />34 1. The -final decision taken by thc city has previously received certification of approval from <br />35 thc commissioner; <br />36 2. The city received certification of approval after its final decision; <br />37 3. Thirty days have-clapscd from the day thc commissioner received notice of thc final <br />38 decision, and the city has received from the---eommissie-n-cr neither certification of <br />39 approval nor notice of non approval; or <br />40 1. The-eommissioncr certifies approval within 30 days after conducting a publiccaring <br />41 d. In cas-e the commissioner gives notice of non approval of an e-Fdinance, variance or <br />42 +e•eonsiste-t plat, ^ -cr the applicant or the-a-dministrator mayTwithin 30 days of said notice, <br />43 file with the commissioner a demand for hearing. If the demand for hearing is not made within <br />44 30 days, the notice of non approval becomes final. <br />45 1. The-b-caring will bc held in an appropriate local community -within 60 days of thc demand <br />46 and after at least two weeks published notice. <br />47 2. The hearing wi-I-I be -conducted in accordance with Minn. Stats. § 103G.311. <br />48 3.
