CASE #1

REVIEW PROPOSED ORDINANCE LANGUAGE
AMENDING CHAPTER 8 OF THE CITY'S CHARTER
By: William K. Goodrich, City Attorney

Back~round:

At the April 27, 2006 meeting, the Charter Commission reviewed Chapter 8 of the City's Charter
relating to public improvements and special assessments. Staff suggested the intent of the
language was to protect the City's citizens/tax payers; however, the way it is written, developers
are able to take unreasonable advantage of this protection. The Charter Commission directed the
City Attorney to draft language to specifically address developers and the special assessment
process.

Recommendation:

Attached to this case is the proposed ordinance language to amend the City's Charter. The
Commission should review the language and, upon consensus, make a motion to send it on to the
City Council for adoption. The City Council would hold a public hearing to introduce the
ordinance. At the following meeting, the ordinance would be brought forward for formal
adoption. If the Council passes the ordinance unanimously, it would be published in the City's
official newspaper. If there is no petition against this amendment during the 90 days following
publication, the language would become a part of the City Charter.

Commission Action:

Motion to recommend that the City Council enact a Charter Amendment by adoption of the
attached ordinance, which ordinance amends subsections 8.42 and 8.44 of the City Charter.

Reviewed by:

City Attorney
City Administrator
City Clerk

Charter: 05/22/06
