CASE #1 <br /> <br />REVIEW PROPOSED ORDINANCE LANGUAGE <br />AMENDING CHAPTER 8 OF THE CITY'S CHARTER <br />By: William K. Goodrich, City Attorney <br /> <br />Back~round: <br /> <br />At the April 27, 2006 meeting, the Charter Commission reviewed Chapter 8 of the City's Charter <br />relating to public improvements and special assessments. Staff suggested the intent of the <br />language was to protect the City's citizens/tax payers; however, the way it is written, developers <br />are able to take unreasonable advantage of this protection. The Charter Commission directed the <br />City Attorney to draft language to specifically address developers and the special assessment <br />process. <br /> <br />Recommendation: <br /> <br />Attached to this case is the proposed ordinance language to amend the City's Charter. The <br />Commission should review the language and, upon consensus, make a motion to send it on to the <br />City Council for adoption. The City Council would hold a public hearing to introduce the <br />ordinance. At the following meeting, the ordinance would be brought forward for formal <br />adoption. If the Council passes the ordinance unanimously, it would be published in the City's <br />official newspaper. If there is no petition against this amendment during the 90 days following <br />publication, the language would become a part of the City Charter. <br /> <br />Commission Action: <br /> <br />Motion to recommend that the City Council enact a Charter Amendment by adoption of the <br />attached ordinance, which ordinance amends subsections 8.42 and 8.44 of the City Charter. <br /> <br />Reviewed by: <br /> <br />City Attorney <br />City Administrator <br />City Clerk <br /> <br />Charter: 05/22/06 <br /> <br /> <br />
