CASE #: ~ <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF RUM RIVER MEADOWS; <br />CASE OF NATIONAL GROWTH, LLC <br /> By: Patrick Trudgeon, AICP, Community Development Director <br /> <br />Background: <br /> <br />National Growth LLC has appIied for final plat and final site plan review for Rum River <br />Meadows in order to develop 23 detached townhomes. Rum River Meadows received contingent <br />preliminary, plat approwd on July 26, 2005. At the same meeting, findings were adopted by the <br />City Council supporting the rezoning of the property to Planned Unit Development (PUD) and <br />the ordinance rezoning the property to PUD was introduced. The following items are enclosed <br />~br your information: <br /> <br />a) Sitelocation map <br />b) Final Plat/Site Plan <br />c) City CounciI meeting minutes dated July 26, 2005 <br />d) Staff Review Letter dated May 19, 2006 <br />c) Proposed resolution for Final Plat approval <br />F) Proposed Development Agreement <br /> <br />Notification: <br /> <br />Jn accordance with state statute, notification was made of the preliminary plat public hearing in <br />2005. There are no requirements for final plat notification. <br /> <br />Observations: <br /> <br />The preliminary plat fbr Rum River Estates went through considerable discussion and <br />deliberation with the City Council. On July 26~ 2005, the City Council granted preliminary plat <br />approval tbr Rum River Estates contingent on the following items. <br /> l. Compliance with City StaffReview Letter dated May 6, 2005; <br /> 2. The City having acquired marketable title to the following permanent easements <br /> necessary for the Potassimn Street right-of-way: <br /> <br />A majority of the discussion regarding the plat involved the improvement of Potassium St. As <br />the City Council will recall, the City has been maintaining Potassium St. on property that is <br />owned by several property owners. It has been determined by the CiD, Attorney that the City has <br />the ability to continue to use this area as a public mad since we have been maintaining it as road <br />lbr many years. The City Council has authorized the use of eminent domain to purchase <br />additional land needed for the use as Potassium St. Staff and City representatives have been in <br />contact with the property owners affected by the Potassium St. project.
