It is understood that as part of the Shade~ree Cottages plat, located immediately to the west of <br />Rum River Meadows, that the new Potassimn St. would be constructed, l~t is also been verbally <br />agreed that the City, would pay for 50% of the cost of securing the necessary right-of-way and <br />construction of Potassium St. that will serve both Shadetree Cottages and Rum River Estates. <br />The developers of d~ese two snbdivisions will pay for the remaining 50% of these costs. As the <br />final plans for Shadetree Cottages and Potassium St. have not been approved as of yet, any <br />approval that the Council would want to consider for Rum River Meadows would need to be <br />contingent on the construction of Potassium St. <br /> <br />The final plat and site plan show a total of 23 detached townhome in the same number and <br />locations as indicated on the preliminary plat. Overall the submitted final plat is consistcnt with <br />the approved preI[minm¥ plat. Staff is continuing to review the street, utility, grading, and <br />drainage plan and may have future comments as indicated in the Staff Review letter. <br /> <br />As indicated in the Stal'f Review Ietter, the applicant must receive ~pproval from the Lower Rum <br />River WMO regarding the wetland sequencing and mitigatio~ plan. <br /> <br />As part of the preliminary, plat discussion, the City Conncil passed a motion for Staff to begin <br />negotiation with property owners to the north for the City to receive a "right of first refusal" on <br />the f~.~ture sale of their land in order for the City to potentially create a second ingress/e~'ess to <br />?,urn River Meadows. Stai-Thas identified several parcels located in the River Pines subdivision <br />that could serve as a future second access to and from the Rum River Meadows subdivision and <br />will soon be contacting the identified property owners. <br /> <br />The City Council adopted findings of fact suppod-ing the rezoning of the parcel to Plmmed U~St <br />Development. The Rum River Meadows PUD will allow for the 3.3 net density as sl~own on the <br />plat as well the following deviations ii'om City Code: 1) A lesser structure setback between units <br />(15 feet instead of the required 20 feet), and 2) the use of detached townhome units as part of the <br />development. <br /> <br />Recommendation: <br /> <br />Staff is recommending approval of the final plat subject to the following: <br /> <br /> 1) Compliance xvith City Staff Review Letter dated May 19, 2006 <br /> 2) The City and the Developer entering into a Developmeut Agreement <br /> 3) Approval of the Shadetree Creek final plat. <br /> 4) Construction of Potassimn St. as pm't of the Shadetree Creek plat. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #06-04-__ to approve the final plat and final site plan of Rum <br />Rivet' Estates snbject to the following conditions: <br /> <br />-108- <br /> <br /> <br />
