I-Iuwever, there is no indication of any fillhlg of that portion of the we'.land. No trees <br />should be removed fi'om any areas that are outside the limits of any construction activity. <br /> <br />Finally, any clearing involving oak trees cannot occur between April 15 and July 15 to protect against oak <br />wilt, when trees are most susceptible to this disease. Furthermore, due to the number of northern pin oaks <br />on the site, a plan outli~zing the steps that will be taken to protect these trees fi'om oak wilt throughout the <br />construction process must be submitted prior to commencement of construction. <br /> <br />15. Ground Cover/Irrigation, City Code requires ali areas otherwise not improved to be established with sod. <br /> Siaff is assumhrg that the development will comI~ly with this requirement. An irrigation system will need to <br /> be provided thropghout the development where sodded and landscaped areas are established. The proposed <br /> in'igation system will need to be reviewed by the City Engineer. The irrigation system will need a dedicated <br /> · service(s) that must be shown on the utility, plan. ' <br /> <br />16. Sidewalks. A sidewalk is required on one side of' all non euI-de-sac public streets, unless the City <br /> determines it is necessaLv to provide a sidewalk along a cul-de-sac street. The final plat plans show a. <br /> sidewalk along the north side of 157th Avenue as directed. <br /> <br />17. Trail Development. The Park and Recreation Commission recommended that a trail be installed <br /> connection with the proposed boardwalk to the northeastern comer of the property. This would facilitate a <br /> future pedesn'ian cmmection to Highway #47. Trail fees will be required as part of the platting process. The <br /> rate in effect at time of final plat will be applied. The 2006 rate is $580 per unit, which equates to $12,650 <br /> for this development. <br /> <br />18. Park Dedication. Park dedication can be met by land, cash or a combination of land dedication and cash <br /> payment. The Park Commission recommended that park dedication be satisfied through a cash payment, <br /> which equates to $55,200 (23 units ~ $2,400/unit). <br /> <br />19. Sanitary Sewer and Water Trunk Fees: The city has established a sanitary sewer and water trunk fee that <br /> must be paid prior to release of the final plat for recording. The 2006 Rate is $3,062 per lot. The total <br /> amount due is $70,426.00 ($3062 x 23 units). This amount must be paid prior to the release of the final plat <br /> for recording. <br /> <br />20. Stormwater Management Fee: A storm water management fee of $397 per nnit must be paid for all new <br /> lots created. The total amount due, based on the 2006 rate, is $9,131.00 ($397 x 23 units) and mast be paid <br /> prior to release of the final plat. <br /> <br />21. Other Permits. The applicant is responsible for any other permits required by other regulatmy agencies. <br /> <br />22. PUD. The following deviations fi'om Ci.ty Code have been reviewed by the City Council and, based <br /> rezoning of the development parcel by tile City Council to PUD, will be allowed as part of the Rum <br /> Meadows subdivision. <br /> <br /> a.
