MSEY, <br />a municipal corporation under the laws of the State of Mim,esota (the "CITY"), and <br />NATIONAL GROWTH, LLC, a Mirmesota limited liability corporation, whose address is <br />16250 Royal Road, Ramsey, ivfN 55303 "DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> ¥~ HEREAS, the I)EVELOPER is the fee owner of the following described property <br />situated in the CiTY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />The north 330.00 feet of the Northwest Quarter of the Northeast Quarter of Section 23, <br />Township 32, Range 25, together with an easement for road purposes over the west <br />33.00 feet of that part of the Northeast Quarter of said Section 23 which lies north of <br />County State Aid Highway No. 5, according to the United States Goverrm~ent survey <br />thereof, Anoka County, Minnesota. <br /> <br />-or upon recording- <br /> <br />Lots 146, Block 1 and Lots 1-7, Block 2, Anoka County, Mimmsota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on July 26, 2005, pursuant to Resolution No. 05-07~228, the CITY adopted <br />findings of tact #728 supporting thc rezoning of the Subject Property from R-1 Residential to <br />Planned Unit Development ((PUD) to facilitate the development of RUM RIVER MEABOWS <br />(the "Plat"; and <br /> <br />-136- <br /> <br />Development Agreement <br />Pa~,e 1 of 12 <br /> DraJ~ 5. ] 9. 06 <br /> <br /> <br />
