5) This Permit restricts the hours of access to the Subject Property for the purposes of accessing <br /> the travel trailers audi'or R_Vs as follows: <br /> o Monday through Thursday: 8:00 a.m. to 8:00 p.m. <br /> o Friday aud Saturday: 8:00 a.m. to 5:00 p.m. <br /> Sunday: No access. <br /> <br />6) <br /> <br />This Permit shall become null and void in the event site operations permanently cease prior <br />to the expiration date or upon the expiration date, whichever occurs first. All RVs and travel <br />trailers mnst be removed from the Subject Property within sixty (60) days of the date of <br />terminatiou or the e×pir,~xion date of the Permit, whichever occurs first. Upon City Council <br />approval, thc Pcrmittee shall provide a financial guarantee to the City, in the amount of Five <br />Thousaud Dollars and no cents ($5,000.00) to ens~tre timely removal of all RVs and travel <br />trailm's. Iu the eveut the Permittee fails to perform said timely removal, the Permittee herein <br />grants the City authority to draw upon the financial surety to remove said items from the <br />Subject Property. '/'he financial guarantee may be in the form of cash or some other form that <br />is determined 'to be acceptable to the City. Tkis financial guaran, tee shall be maintained as <br />long as the Permit remains in effect and until all RVs and travel trailers are properly removed <br />from ~he Subject Property. <br /> <br />7) That all costs incun-ed by the City in administering and enforcing this Pennit shall be tile <br /> resi~onsibility of the Permitlee. <br /> <br />That the City Administrator or his or her designee shall have the right to inspect the Subject <br />Property tbr compliance and safety purposes at any time. <br /> <br />9) <br /> <br />That tile failure o? the City at any time to require performance by the Permittee of any <br />provisions herein shall in no way affect the right of the City thereafter to enforce the same. <br />Nor shall waiver by the City of'any breach of any of the provisions hereof be taken or held to <br />be a waiver o1~ any succeeding breach of such provision or as a waiver of any provision itsel£ <br /> <br />I0)That if any provision of this Permit shall be declared void or unenforceable, the other <br /> prov[sions shall not be afl'cereal but shall remain in full force and effect. <br /> <br />1 l)That this Permit shall not be considered modified, aItered, changed or amended in any respect <br /> uuless in writiug and signed by the City and the Permittee. <br /> <br />12) That il' the Permittee or its successors or assigns violates any material term or condition of <br /> this l>em~it, it is gronnds for suspension or revocation hereof consistent xvith applicabIe law. <br /> Sf~ccifically, but without limitiug the foregoings, tire City may amend, suspend, or revoke this <br /> Permit, co~sis[ent with applicable law, if the City Council reasonably determines that <br /> contim[ed operation of the facility places the public health, safety or welf~xm or the <br /> e:]vh'onment in jeopardy or creates a public nuisance due to odors, litter, debris or other <br /> m~ism~ce £actors.
