5) This Permit restricts the hours of access to the Subject Property for the purposes of accessing the travel trailers audi'or R_Vs as follows: o Monday through Thursday: 8:00 a.m. to 8:00 p.m. o Friday aud Saturday: 8:00 a.m. to 5:00 p.m. Sunday: No access. 6) This Permit shall become null and void in the event site operations permanently cease prior to the expiration date or upon the expiration date, whichever occurs first. All RVs and travel trailers mnst be removed from the Subject Property within sixty (60) days of the date of terminatiou or the e×pir,~xion date of the Permit, whichever occurs first. Upon City Council approval, thc Pcrmittee shall provide a financial guarantee to the City, in the amount of Five Thousaud Dollars and no cents ($5,000.00) to ens~tre timely removal of all RVs and travel trailm's. Iu the eveut the Permittee fails to perform said timely removal, the Permittee herein grants the City authority to draw upon the financial surety to remove said items from the Subject Property. '/'he financial guarantee may be in the form of cash or some other form that is determined 'to be acceptable to the City. Tkis financial guaran, tee shall be maintained as long as the Permit remains in effect and until all RVs and travel trailers are properly removed from ~he Subject Property. 7) That all costs incun-ed by the City in administering and enforcing this Pennit shall be tile resi~onsibility of the Permitlee. That the City Administrator or his or her designee shall have the right to inspect the Subject Property tbr compliance and safety purposes at any time. 9) That tile failure o? the City at any time to require performance by the Permittee of any provisions herein shall in no way affect the right of the City thereafter to enforce the same. Nor shall waiver by the City of'any breach of any of the provisions hereof be taken or held to be a waiver o1~ any succeeding breach of such provision or as a waiver of any provision itsel£ I0)That if any provision of this Permit shall be declared void or unenforceable, the other prov[sions shall not be afl'cereal but shall remain in full force and effect. 1 l)That this Permit shall not be considered modified, aItered, changed or amended in any respect uuless in writiug and signed by the City and the Permittee. 12) That il' the Permittee or its successors or assigns violates any material term or condition of this l>em~it, it is gronnds for suspension or revocation hereof consistent xvith applicabIe law. Sf~ccifically, but without limitiug the foregoings, tire City may amend, suspend, or revoke this Permit, co~sis[ent with applicable law, if the City Council reasonably determines that contim[ed operation of the facility places the public health, safety or welf~xm or the e:]vh'onment in jeopardy or creates a public nuisance due to odors, litter, debris or other m~ism~ce £actors. The cleanse, aheration or amendment of an), statute, regulation, ordinance or permit co~lditiou by any govermnental authority other than the City, shall not excuse the Permi~me 5'om compliance with statutes, regulations, ordinances m' Permit conditions in effect on the date of the original issuance of this permit unless compliamce is waived or excused by the City.
