USE AGREEMENT <br />THIS USE AGREEMENT (the "Agreement") is made and effective on the date of signature <br />by and between the County of Anoka through its Highway Department, (the "Owner"), and <br />the Ramsey Fire Department, in Ramsey, MN ("User"). <br />WHEREAS, Anoka County is the owner of certain buildings located on Highway 10 at <br />Ramsey Blvd. and Highway 10 at Sunfish Lake Blvd., in the city of Ramsey, Minnesota, <br />which are more specifically described in Exhibit A attached hereto (the "Highway <br />Properties"); and, <br />WHEREAS, User desires to use the Highway Properties for its Fire Department exercise <br />training, not to include any live burn training; and <br />WHEREAS, the Owner has agreed to allow the User to use the Highway Properties at a cost <br />of $0.00, pursuant to the terms and conditions in this agreement. <br />NOW, THEREFORE, in consideration of the mutual understandings and agreements <br />hereafter set forth, the Owner and User agree as follows: <br />1. Term. This Agreement shall run from the date of execution to December 31, 2023 at <br />which time it will terminate. User and its officials, employees, volunteers, and members shall <br />be entitled to use the Highway Properties for the dates and time periods specified. <br />2. Cancellation. The Owner shall retain the right to cancel this agreement without penalty <br />upon notice to the user at the address set forth below. User may cancel this agreement by <br />providing the Owner written notice of cancellation at any time. <br />3. Use of the Highway Properties. User agrees to be bound by and comply with all <br />firefighting safety standards and any applicable federal, state, municipal and local laws, <br />ordinances, and regulations while occupying or using the Highway Properties. User shall be <br />responsible for providing all applicable rules and regulations to and ensuring compliance with <br />the same by User's officials, employees, volunteers, and members. The Owner may terminate <br />this Agreement at any time for a violation of the terms of this Agreement, or a violation of any <br />law, ordinance, or regulation. <br />Prior to each use of the Highway Properties, the User will provide proper advance notice to <br />Hilary Dischinger, Right of Way Specialist with Anoka County Highway Department. User <br />will also provide prior to use a detailed training plan (tentative plan is attached as Exhibit A) <br />that outlines the training that will be performed, which buildings will be used, and date, time, <br />and duration of the training. The User will be responsible for public notification, a safety plan, <br />and securing the perimeters of the Highway Properties while in use. <br />4. Property Damage. User shall not make alteration to, deface, or damage the Highway <br />Properties or any portion thereof without prior authorization from the Owner. User will <br />coordinate with Owner to review allowable interior damage to the structure prior to use. <br />
