6. 1. <br />CC Regular Session <br />Meeting Date: 09/12/2023 <br />PrimaryStrategic Plan Initiative: Identify and implement operational efficiencies, cost savings and additional <br />g funding sources. <br />Information <br />Title: <br />PUBLIC HEARING - Introduce Ordinance #23-08 to Amend Chapter 4 of the Charter - Nominations and <br />Elections <br />Purpose/Background: <br />Background: Council previously considered Ordinance #23-07 to amend sections 4.5.4 and 4.5.6 of the Charter. <br />That ordinance did not pass. On May 9, 2023, Council discussed language that would be acceptable to update <br />sections 4.5.4 and 4.5.6. The Charter Commission met on July 19, 2023 to review options to update those two <br />sections and ultimately approved proposing the language in Ordinance #23-08, which mirrors language supported <br />by the City Council from May 9, 2023. <br />Purpose: <br />The purpose of this case is to hold a Public Hearing and introduce Ordinance #23-08. The recommended changes <br />are to amend Chapter 4 of the City Charter sections 4.5.4 and 4.5.6. The changes proposed allow the option to <br />appoint a successor in the case of a vacancy until a successor is elected or with less than 365 days left in the term. <br />In order for the appointment to be approved, it must receive unanimous support from all current Councilmembers. <br />Within one month of receiving a recommendation to amend the charter by ordinance, the city must publish notice <br />of a public hearing of the proposal. The city must hold the public hearing on the proposed charter amendment at <br />least two weeks, but not more than one month after the notice is published. Within one month of the public <br />hearing, the city council must vote on the proposed charter amendment ordinance. To pass, the vote must be <br />unanimous, including approval by the mayor. <br />Notification: <br />The City Council received the recommendation from the Charter Commission on August 22, 2023. A Public <br />Hearing was advertised in the City's Official Newspaper, the Anoka County Union Herald. <br />Time Frame/Observations/Alternatives: <br />Next Steps: <br />• Per State Statute 410.12 Subd. 7., the Council must vote on the proposed charter amendment within one <br />month of the public hearing. <br />• The ordinance will come back for final consideration on October 10, 2023. <br />Funding Source: <br />N/A <br />Recommendation: <br />Staff recommends introducing Ordinance #23-08. <br />Outcome/Action: <br />
