Mayor Gamec introduced the following resolution and moved for its adoption:

RESOLUTION #80-87

RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PRO-
POSED ASSESS~ENT

WHEREAS~ a contract has been let for the improvement of
Improvement Project #79-10 Tungsten and Front Street Storm Sewer and the
contract price including capitalized interest for such improvement is
$44,565.38 and the easement acquisition, engineering, fiscal and legal
expenses incurred are estimated to amount to $15,731.79 so that the total
cost of the improvement is estimated to be $60,297.17.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RA~SEY,
ANOKA COUNTY, STATE OF MINNESOTA, as follows:

1) The cost of such improvement to be specially assessed
is hereby declared to be $50,648.99 subject to final actual cost figures.

2) The City Clerk, with the assistance of the City Engineer
shall forthwith calculate the proper amount to be specially assessed for
such improvement against every assessable lot, piece or parcel of land
within the district affected, without regard to cash valuation, as provided
by law, and he shall file a copy of such proposed assessment in his office
for public inspection.

3) The clerk shall, upon the completion of such proposed
assessment, notify the Council thereof.

4) It is the Council's findings that the project does benefit
those residences and parcels adjacent to Rivlyn Avenue, North and South and
that in the future when RivlynAvenue is improved, the storm sewer system
will then be made available to those parcels adjacent to RivlynAvenue at
which time the benefited parcels will be assessed pursuant to Chapter 429
proceedings. Until such time the City will defer the assessment and pay
from its General Fund the sum of $9,648.18 which is the difference between
the amount presently estima%ed to be assessed, $50,648.99 and the total
project cost of $60,297.27 ($60,297.17 - $50,648.99 = $9,648.18). This
deferment action is being taken pursuant to MSA Chapter

5) Because the cost figures above are estimated any in-
creases or decreases when specifically known will be referred to the City
Council for its further action.

The motion for the adoption of the foregoing resolution was duly seconded
by Councilman Sorteberg and upon vote being taken thereon, the following
voted in favor thereof:

Mayor Gamec, Councilmen Sorteberg and Reimann
