-2- <br /> <br />at which time it reviewed the PUD application and made a written recommendation <br />to the City Council that the preliminary development plan for the PUD be <br />approved; and <br /> <br /> WHMtEAS, on the 20th day of February, 1984 the City Council conducted a <br />public hearing on the application for the PUD which public hearing was properly <br />noticed by a publication in the City's legal newspaper on the 17th day of <br />February, 1984; and <br /> <br /> WHEREAS, at its regular Council meeting held on February 28, 1984 the City <br />Council adopted its Resolution No. 84-34 which is a Resolution approving the <br />preliminary PUD of Flintwood Hills Second Addition; and <br /> <br /> WHEREAS, at its regular nmeting on March 6, 1984 the City's Planning <br />Commission found that the final PUD was in substantial compliance with the plan <br />it had given preliminary approval to on February 7, 1984; and <br /> <br /> WHERFAS, an Environmental Assessment Worksheet was prepared and submitted to <br />Minnesota's Environmental Quality Board (EQB) which Board established a thirty <br />(30) day public comment period and that comment period ended April 11, 1984; <br />and <br /> <br /> ~EREAS, the Council by its Resolution No. 84- 83 has adopted Findings of <br />Fact and a Resolution whereby it finds that the proposed Flintwood Hills Second <br />Addition PUD does not have the potential for significant environmental affects; <br />and <br /> <br /> WHERFAS, the City has heretofore adopted code regulations providing for the <br />installation of nmnicipal utilities in its Urban Area which is the area in which <br />the proposed PUD is located; and <br /> <br /> WHEREAS, the City has a drainage system requirement for storm water runoff <br />which system will be a necessity for the .subject PUD; and <br /> <br /> WHMtEAS, the City does require that the Applicant pay one-half (1/2) of the <br /> <br /> <br />
