These improvements include the construction of those streets within the <br />p]ai, k.~wr~ as Iguana Street Northwest, 174th Avenue Northwest, and 176th Avenue <br />Nor~hwcs';, and Outlot G of Countryside Estates Addition, including bituminous surfacing <br />and r,]ated ditches, grading, backslopes and drainage. The Developer shall be <br />r(~s!.,(,n~ihie for any expense associated with the construction of these improvements. The <br />Dcvelogc~ shall restore all disturbed areas as specified by the City Engineer. The <br />I)~we!ooc~ shall also provide erosion control measures during construction to control <br />cro,~i,m The Developer shall complete Stage I Improvements on or before October 31, 1989. <br /> <br />]r!.SI_/',_~(~IAL._(.)_UARAb{_T_EE. The Developer shall provide a financial guarantee for the <br />con.~truct:im~ of these improvements. This guarantee shall be in the form of cash or City <br />~cttcr of Credit in the amount of One hundred thousand ($100,000) dollars, which <br />r,presents 125% of the EngineeFs estimated cost for such improvements. In <br />thc Letter of Credit, the Developer shall post a maintenance guarantee at the <br />completion of the improvements in the amount of Five thousand ($5,000.00) <br />T)fis security shall be deposited with the City in the form of cash escrow or a Letter <br /> a Corm to be acceptable to the City. This security shall be held by the City for One <br /> fr,.m~ the date of final acceptance of the improvements. <br /> <br />(B(k~0)_.[N.('._ A_A_N2D DRAI_~AGE PLAN. The Developer shall comply with grading and <br />d,'ai,~:~? pimps submitted to and approved by the City Engineer. <br /> <br />I,]A~_~ EiS)~_&~_ SETBACKS. The Developer agrees to provide a street easement of sixty- <br />six (6~/) t'c~t in width running generally along the alignment of the proposed property line <br />of l,(~l,.,: ~0 and 11, Block 2 of Wildwood Acres. In addition, the Developer agrees that any <br />stru,'.t.u~'~(~,~) on Lots 6, 7, 8, 9, and 10, Block 2 of Wildwood Acres will be at least fifty (50') <br />fee~t :¥,m the natural gas pipeline easement. <br /> <br />}_~H~!)~IN~_. P.E]2~MIT_~. The Developer agrees that in compliance with City Code, no <br />buildi,,~: ~),rmits for any lot in the plat shall be issued until the financial guarantees as <br />de.~;c,Sh(,.d ~bove have been provided and that Class #5 material shall be in place for any lot <br />which ~, ])~.;Iding permit is issued. <br /> <br /> i'~t'.]__13__MIrI'S &~REGULATIONS. The Developer shall be required to be in <br /> with all permitting and regulating agency requirements (e.g., U.S. Army <br />E~,~?,'ineers, Anoka DOT, DNR, etc.) appropriate to the development of the land. <br /> <br />F/~[,~ !_i~ I]KI{ROVEM__ENTS. The Developer shall be required to complete Stage 2 <br />] m prove m e~s (sealcoating) as provided in Section 170.03 of the City Code.
