~rvI~ROVEMENTS. The Developer will construct improvements shown on the plans <br /> directed by the City Engineer, in accordance with the City standards and <br />;~pccifications. These improvements include the construction of those streets <br />v~,ithin the plat known as Okapi Street NW and 158th Lane NW, including <br />bilL, ruinous surfacing and related ditches, grading, backslopes, drainage and <br />:~e.~ding. The Developer shall also be responsible for restoration of the Okapi <br />;;tr~:~et NW and 158th Lane NW cul-de-sacs to facilitate through traffic. The <br />~:)eveloper shall be responsible for any expenses associated with the construction <br /> these improvements. The Developer shall restore all disturbed areas as <br />,~;pecified by the City Engineer, The Developer shall also provide erosion control <br />~r~e~:~sures during construction to control erosion. <br /> <br />J~I[q~&N_C,_~AI~GUARANTEE. The Developer shall provide a financial guarantee for <br />the construction of these improvements. This guarantee shall be in the form of <br />cash or City approved Letter of Credit in the amount of Sixty-four Thousand Five <br />I lu~dred Dollars ($64,500.00), which amounts to 125% of the Engineer's <br />estimated cost for such improvements. In addition to the Letter of Credit, the <br />~)eveloper shall post a maintenance guarantee at the time of the completion of the <br />improvements in the amount of Five Thousand Dollars ($5,000.00). This <br />,~,curity shall be deposited with the City in the form of a cash escrow or a Letter <br />~.~f Credit in a form to be acceptable to the City. This security shall be held by the <br />~;ity for One (1) year from the date of final acceptance of the improvements. <br /> <br />.G_U/_\OING AND DRAINAGE PLAN. The Developer shall comply with grading and <br />drainage plans submitted to and approved by the City Engineer. <br /> <br />~_[:i~ REMOVAL/DISEASEDTREE CONTROL. The Developer shall prevent the <br />i,:droduction and spread of tree disease into the residue tree populations of the <br />,,~ubdivision and adjoining properties and to reduce the impacts of construction on <br />the residual property of the subdivision and adjoining properties. The Developer <br /> <br />Install physical barriers such as snow fence around trees that are to <br />remain (the fencing will be at least ten feet (10') from the remaining <br />trees; <br /> <br />All equipment operators will carry a can of tree wound dressing and will <br />apply immediately to damaged trees if wounding occurs; <br /> <br />Trees will only be skidded against other trees that are to be removed. <br />Trees in the middle twenty feet (20') of road easement will be removed <br />first, with remaining trees to be removed to be skidded toward the middle <br />of the road easement. <br /> <br />.(.~;~O_.r~.~...R.
