No waste materials shall be stored on the site which are not utilized in <br />the aluminum processing operation or properly identified as materials incidental to the <br />processing operation. Such materials are limited to aluminum, brass, copper, stainless steel <br />and other non hazardous metals received as a small portion (less than 10% by volume) of an <br />aluminum feedstock load. <br /> <br />Fire Extinguishers. The Permit Holder shall, at all times, have a sufficient supply of fare <br />extinguishers located throughout the operation in conformance with the Uniform Fire Code. <br /> <br />Fire Lanes. The Permit Holder shall properly construct and maintain all season paved fire <br />lanes or properly pave and maintain drives and clearances to serve as fire lanes for the street <br />side of the property to the back of the property. <br /> <br />Contingency Action Plan. The owner or operator must prepare and maintain a contingency <br />action plan for the aluminum processing facility. The plan must discuss what specific actions <br />will be taken if a fire, spill or release occurs at the facility and that back-up system exists if <br />portions of the facility are closed for any period of time. The plan must also identify a <br />responsible contact person or persons for the facility who could be reached 24 hours a day in <br />the event of a fire, spill, release or other serious problems along with their home addresses <br />and phone numbers. -' <br /> <br />Hours of Operation. The Permit Holder may conduct his receiving operations within the <br />hours of 7:00 a.m. to 8:00 p.m. Monday through Saturday, and may conduct aluminum melt <br />operations 24 hours a day, seven days a week unless the operations present a nuisance or <br />disturb neighboring land uses. The City Council may limit hours of operation to protect <br />neighboring land uses. <br /> <br />Trailer/Vehicle Storage. The use of trailers, trucks or vehicles for long term storage (longer <br />than 30 consecutive days) is prohibited. All vehicles and trailers on site must bear a current <br />license, be registered, and must be road worthy. <br /> <br />.Structures and Site Improvements. The placement, design and construction of new structures <br />or additions to existing structures and site improvements shall comply with City Code as <br />provided within the development agreement, and applicable state codes and OSHA <br />requirements. <br /> <br />Building Permits. No building permit for the site will be issued until: 1) the southerly half of <br />142nd Avenue N.W. is improved from Jaspar Street N.W. to 160' west of the N.E. comer <br />of Lot 2, Block 1, Gateway North Industrial Park; and 2) Cash or Letter of Credit is <br />deposited with the City in an amount equal to 150% of the City Engineer's estimated cost of <br />improving all of 142nd Street N.W. from Jaspar Street N.W. to Limonite Street N.W. to City <br />standards with the exception of bituminous surface. No certificate of occupancy for <br />occupancy of any building on the site will be issued until 142nd Avenue N.W. has been <br />improved to City standards and accepted by the City except that bituminous surface is not a <br />requirement for a Certificate of Occupancy to be permitted. The Permit Holder herein agrees <br />to join in petitions for all such, roadway improvements when such petitions are assembled. <br /> <br />Sanitary Sewer. The Permit Holder agrees to connect to City sewer and water at the time <br />sewer and water is extended to the area and herein agrees to join in a petition for such <br />improvements when such petitions are presented. <br /> <br />Work and Storage Operation Enclosed. All operations must be within a fully permanently <br />enclosed building. <br /> <br /> <br />
