Councilmember Cook stated that he would rather see gazebos than cars. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Resolution #06- <br />02-065 to adopt Findings of Fact #0753 to support the adoption of the Interim Use Permit, as <br />amended, to allow retail sales with an outdoor display area on the property of 6246 Highway 10 <br />for a period of two years. <br /> <br />Further discussion: Councilmember Elvig expressed concern that they are limiting what kind of <br />retail can be sold on the property. Councilmember Cook stated that gazebo sales are a use that is <br />closer to the original use. Councilmember Elvig inquired if it was possible to limit the use. Mr. <br />Lano noted that it is a Interim Use Permit limited to two years. Councilmember Elvig stated that <br />he liked the gazebos, but doesn't want it to turn into something else such as a flea market. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson to adopt Resolution #06- <br />02-066 approving the issuance of an amended Interim Use Permit for retail sales with outdoor <br />display based on Findings of Fact #0753 and declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey, <br />Pearson and Strommen. Voting No: None. <br /> <br />Case #7: <br /> <br />Consider Resolution Approving the Appraisal of Damages for the <br />Acquisition of Permanent Easements for Street, Drainage and Utility <br />Purposes for the Improvement of Potassium Street NW <br /> <br />City Attorney Goodrich advised that by a resolution in June 2005, the City Council authorized <br />the commencement of an eminent domain action for the purpose of acquiring right of way for the <br />improvement of Potassium Street NW. As a part of that action, an appraisal of the damages each <br />of the affected parcels will suffer as a result of the taking has been completed. The statutory <br />process required that the Council approve the appraisal. <br /> <br />Councilmember Cook stated that it was his understanding that there was a location into the <br />wetland being considered by the Rum River Watershed District, but a decision has not been <br />reached as of yet. Would any action be contingent upon that decision being made or is it <br />something that they will continue to watch. <br /> <br />City Attorney Goodrich replied that is something they can monitor during the 90-day waiting <br />period before the City can take acquisition. <br /> <br />Councilmember Elvig stated that he has been contacted by several of the impacted property <br />owners.
