The original Interim Use Permit was approved by the City Council on December
13, 2005, and allowed for the sales and outdoor display of vehicles. The applicant has requested
that the permit be amended and approved for retail sales and outdoor display generally, and not
be restricted to vehicles. On September 27, 2005, Lumax, LLC submitted an application for a
Conditional Use Permit to allow the sales and outdoor display of vehicles on the property located
at 6246 Highway 10, owned by Brad Lano. On December 13, 2005, the City Council approved
an Interim Use Permit to allow the sales and outdoor display of vehicles for a period of two
years, renewable for an additional two years. Since December, Mr. Lano has found another
potential lessee for the property. This company would like to use the property for the sales and
assembly of gazebos. Because the approved permit specifically allows outdoor display and sales
of vehicles, an amendment to the original Interim Use Permit was required. City staff
recommended approval of the amended Interim Use Permit to allow retail sales and outdoor
display.

City Council / February 28, 2006
