The HRA is executing this Declaration to create certain appurtenant easements for <br />the construction, use, maintenance, repair and replacement of drive lanes that will provide <br />vehicular ingress and egress between the Lots and Sunwd Drive and for the cnstruetin, use, <br />maintenance, repair and replacement of private utilities and to establish covenants and <br />restrictions relating to the maintenance, repair and replacement of the improvements located <br />within the easements and relating to the use of the Lots, all for the mutual benefit of the Owners. <br />. In addition, to satisfy one of the requirements the City of Ramsey, Milmes to (the <br />"City") imposed in connection with the City's approval of the final plat of COR TWO, the LIRA <br />desires to grant the City an easement in gross over and across the Lots to permit the City t <br />inspect and, if the City deems it necessary and appropriate to repair private water lines and storm <br />sewers located on the Property. <br />. The HRA may, in the future, execute and record one or more amendment.s to this <br />Declaration subjecting all or any portion of certain real property located in the City of Ramsey, <br />Anoka County, Minnesota, which is legally described as Lots 1 and 2 and Outlot A, RAI SE <br />TOWN CENTER 3 Ro ADDITION, Anoka County, Minnesota (collectively the "Northstar <br />Property") according to the provisions of this Declaration, all as provided in Section 10 hereof. <br />N rth tar Marketplace Station, LL , a Delaware limited liability company "I orthstar" <br />currently owns the Northstar Property. <br />Now, therefore, the LIRA hereby declares and creates for the benefit ofthe Owners, the <br />easements, covenants and restrictions described herein. <br />111. AGREEMENT <br />T <br />1. Recitals. The Recitals set forth above are a part of this Declaration. <br />. Grant of Easements. The HRA hereby declares and grants the following <br />easements: <br />A. Nest Access Easementh <br />(i) Grant of Easement. The HRA declares a perpetual, non-exclusive, <br />appurtenant easement over, under and across the portion of the' <br />HRA Property legally described and depicted on the attached <br />Exhibit A (the "west Access Easement Property") for vehicular <br />access between Lot 1, Lot 2 and Lot 3 and Sunwod Drive, a <br />dedicated on the plat of C R TWO, Anoka County, Minnesota <br />(the "west Access Easement". The west Access Easement is <br />appurtenant to Lot 1, Lot 2 and Lot 3 and is intended for the use of <br />the Owners of those Lots and their respective tenants, licensees, <br />invitees and guests. The west Access Easement does not grant the <br />Owners of those Lots or their respective tenants, licensees, invitees <br />and guests the right to park vehicles on the west Access Easement <br />Property. <br />2 <br />4573445vl7 <br />
