WHEREAS, the home on the Subject Property has been the site for trespassing and there <br />appear to have been fires lit inside the home, causing a threat and potential hazardous situation; <br />and <br /> <br />WHEREAS, Minnesota Statute 463.251 allows the City to secure vacant buildings; and <br /> <br />WHEREAS, Minnesota Statute 463.151 allows the City to Remove Hazardous Buildings. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, that the following actions are <br />hereby authorized: <br /> <br />A. Securing of the building by the City and its abatement contractors as allowed per Minnesota <br />Statute 463.251; <br />B. Posting the home unfit for human occupancy by the City’s Code Enforcement Official; <br />C. That the home on the Subject Property is in violation of the City’s Nuisance Provisions <br />(Chapter 30) and the International Property Maintenance Code; <br />D. That the City Attorney is directed without delay to obtain required legal approvals through <br />the court system to remove the hazardous structure, septic system, and secure well in <br />accordance with Minnesota State Law and restore land to natural turf; and <br />E. To approve assessment of cost to the property taxes of the owner provided for in State Law. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Riley, and upon a vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Kuzma <br /> Councilmember Specht <br /> Councilmember Riley <br /> Councilmember Howell <br /> Councilmember Musgrove <br /> Councilmember Olson <br />Councilmember Woestehoff <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br /> None <br /> <br /> <br /> <br />Resolution #23-215 <br />Page 2 of 3 <br /> <br />
